1.1 The application sought and gained approval for the erection of a dwelling alongside the existing, Knock Rushen House which is situated at the southern extent of Castletown as the town heads south towards Scarlett. 1.2 The site has been the subject of a number of applications, the most recent of which sought approval for the redevelopment of the site - 12/00909/A - which resulted in confirmation of the principle of the erection of a total of two dwellings on the site, both served by the existing access into the site. 1.3 There were no objections to the application which is the subject of this request for an extension of time. The approval originally granted required that the dwelling be commenced prior to 13th August, 2014 - four years from the date of the approval.
Planning procedure
2.1 The Town and Country Planning (Development Procedure) (No 2) Order 2013, Statutory Document 0238/13 states: "14 (1) Planning approval granted under this Order is taken to be granted subject to the condition that the development must be begun - (a) no later than the end of such period as may be specified in the decision notice relating to the grant; or (b) if no such period is specified, the period of 4 years beginning with the date on which it is granted. (2) The period specified under paragraph 1(a) must not exceed 4 years unless there are special circumstances justifying a longer period. (3) Any person interested in the land to which a grant of planning approval relates may, before the end of the period referred to in paragraph (1), apply in writing to the Department for the extension of that period, and the Department may, if it considers that there has been no material change in circumstances, extend that period".
Assessment
3.1 The applicant is seeking an extension of time of a further unspecified period as the ongoing building works on the Knock Rushen housing development site alongside has had a detrimental impact on the potential sale of the site. This and the fact that as the housing has been built alongside, a future owner may wish to redesign the development approved under PA 10/00898 has lead them to believe that an extension of time for commencement of works is reasonable and necessary.
3.2 The Southern Area Plan has been introduced since the approval of the application but this confirms the designation of the application site as residential whereas previously in the Castletown Plan part of the site was identified as Woodland. As such there is more support now for the application than there was at the time of the approval. 3.3 As such, it is considered that a further year for the commencement of works - ie that works must commence prior to 14th August, 2015 should be allowed.
