Officer's Report
The Site
The application site represents the curtilage of 2 Strathallan Crescent, Douglas. The existing property is a two storey semi detached dwelling which overlooks Douglas Bay.
The Proposal
Proposed is the installation of three roof lights and a sun tunnel. The roof lights and sun tunnel would be installed in the side and rear elevations. The roof lights would measure approximately 1.34m x 0.98m.
Planning History
The previous planning applications are not considered to be specifically material in the assessment and determination of the current application.
Development Plan Policies
The application site is in an area zoned as "Tourism and Residential" identified on the Douglas Local Plan 1998 It is also within a Conservation Area. It is appropriate to consider Environment Policy 35 of the Isle of Man Strategic Plan (20th June 2007).
Consultations
Douglas Corporation have advised that they have no objection to the proposal. Highways Division has not commented
ASSESSMENT Given the nature of the application it is appropriate to consider Environment Policy 35 which states: "Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."
It is considered that the proposed development would not result in a harmful impact to the neighbouring properties or affect the amenity of local residents.
The proposed roof lights and roof tunnel would not be highly visible from the public thoroughfare. It is therefore considered that it would not be detrimental to the character and appearance of the property.
For the above reasons the proposed development is considered to be acceptable and is recommended for approval.
Party Status
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
