The application site represents "Trevelyan" at 18 Palace Terrace on the Queens Promenade in Douglas. This mid terrace building is situated between Place View Terrace and Switzerland Road and adjacent to Marathon and Athol Terrace.
The proposed planning application is seeking approval for the erection of an illuminated sign box displaying the takeaway name above the entrance door on the front elevation of the building. The sign would measure (In depth). The sign would be of red lettering on a white uPVC face with aluminium frame.
The application site is located within the Promenades Conservation Area in Douglas which is zoned as an area of "Mixed Use" under the Douglas South Local Plan adopted by Tynwald in 1998. Within the adopted Isle of Man Strategic Plan, Environment Policy 35 is considered relevant to this proposal;
"Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development".
Environment Policy 37 is also considered relevant and states: "As a general policy, advertisements within Conservation Areas will be permitted only if: i) the proposal preserves or enhances the Conservation Area; ii) the signage is in a style appropriate to the character of the area; iii) traditional materials and finishes are used and glossy and highly reflective materials are excluded from proposals; and iv) internally illuminated box fascia and projecting box signs are excluded from the proposals".
The following planning applications should be considered in the assessment of the current planning application: PA 89/01524/A - Approval in principle for the erection of residential apartments with associated car parking - Permitted PA 10/00243/B - Conversion of part basement level to a takeaway outlet - Pending
The Douglas Corporation have not commented on the proposal. Department of Transport Highways Division do not oppose - has no traffic management, parking or road safety implications.
After assessing the plans and after a discussion with the Conservation Officer, it is judged that the proposed sign would be unacceptable as it would neither preserve nor enhance the appearance or character of the Conservation Area. The proposed signage is considered to be of an inappropriate style for a Conservation Area which in-turn would have a detrimental impact on the character of the area. uPVC projecting illuminating box signs are specifically contrary to Environment Policy 37 (signs within Conservation Areas) as they are not considered to be of traditional style, material or finish, which are grossly inappropriate for the locality. As such, the proposal is not sympathetic to its setting and does it ensure that the special features contributing to the character of the Conservation Area are protected.
As such, it is judged that the proposed development would be contrary to Environment Policy 35 and Environment Policy 37 of Isle of Man Strategic Plan 2007, as such; it is recommended that this planning application should be refused.

R 1. The proposed signage would be contrary to Environment Policy 35 and Environment Policy 37 of the Isle of Man Strategic Plan 2007 by reason of its design and use of materials. It would result in the introduction of an unduly incongruous feature into the street scene, which would neither preserve nor enhance the character or appearance of the Conservation Area and would have a detrimental impact on the visual amenities of the locality.
