PLANNING OFFICER REPORT AND RECOMMENDATIONS Application No.: Applicant: Proposal: Site Address: 14/00823/B Mr Gavin Jasinski Erection of a conservatory to dwelling 8 Croit Ny Kenzie Andreas Isle Of Man IM7 4FA Case Officer: Photo Taken: Site Visit: Expected Decision Level: Officer Delegation Miss Laura Davy Officer's Report 1.0 THE SITE 1.1 The application site is the curtilage of 8 Croit Ny Kenzie, Andreas which is a two storey semi-detached dwelling situated to the western side of the highway. The application site is located at the end of the cul-de-sac. The property adjoins 7 Croit Ny Kenzie. 2.0 THE PROPOSAL 2.1 The application seeks approval for the erection of a conservatory on the rear elevation. The conservatory would be approximately 0,3m from the boundary fence which is shared with 7 Croit Ny Kenzie, the elevation closest to the fence would be constructed of block work and finished with render. The remainder of the conservatory would have dwarf walls with u PVC and glazing above. The conservatory would project towards the rear of the site by approximately 3.9m and would be 4.5m in width. The conservatory would have a hipped roof which would be glazed. 3.0 PLANNING HISTORY 3.1 The previous applications relate to the construction of the estate and not specifically to the application site. 4.0 DEVELOPMENT PLAN POLICIES 4.1 The application site is in an area zoned as "Predominantly Residential" identified on the 1982 Development Order. Given the nature of the application it is appropriate to consider General Policy 2 and Paragraph 8.12.1 of The Isle of Man Strategic Plan (20th June 2007). 4.2 General Policy 2 Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; c) does not affect adversely the character of the surrounding landscape or townscape; g) does not affect adversely the amenity of local residents or the character of the locality. 4.3 Paragraph 8.12.1 As a general policy, in built up areas not controlled by Conservation Area or Registered Building policies, there will be a general presumption in favour of extensions to existing 11 August 2014 14/00823/B Page 1 of 3

property where such extensions would not have an adverse impact on either adjacent property or the surrounding area in general. 5.0 CONSULTATIONS 5.1 No comments received 6.0 ASSESSMENT 6.1 The application seeks approval for the erection of a conservatory on the rear elevation. The main issues to consider in the assessment of the application are the impacts upon the character and appearance of the property and area in general and the impact upon amenities of neighbouring properties. 6.2 The proposed extension would project from the rear elevation by approximately 3.9m, there is an existing fence between the properties which is approximately 1.7m in height, the blockwork wall closets to the boundary would be similar in height to the existing fence, above the blockwork wall is an area of u PVC and glazing which would be approximately 0.5m higher than the wall. A 2m high fence could be erected on the shared boundary under Permitted Development which would be similar in height to the proposed conservatory it is considered that the proposal would not have an adverse impact upon the amenities of the adjoining property in terms of appearing unduly overbearing or result in the undue loss of light. 6.3 The conservatory would be to the rear of the dwelling and therefore would not be overly visible from the public thoroughfare therefore having limited impact upon the character and appearance of the property and street scene in general. 6.4 For the above reasons the application is considered to be acceptable and is recommended for approval. 7.0 PARTY STATUS 7.1 In line with Article 6(4) of the Town and Country Planning (Development Procedure)(No2) Order 2013, the following Persons are considered to have sufficient interest in the subject matter of the application to take part in any subsequent proceedings relating to the application: the applicant or, if there is one, the applicant's agent, and the Local Authority, Andreas Commissioners in whose district the land the subject of the application sits. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. To comply with article 14 of the Town and Country Planning (Development Reason: Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals. This approval relates to Drawing Numbers 1685-01 date stamped 14th July 2014, I confirm that this decision accords with the appropriate Government Circular delegating functions to Director of Planning and Building Control /Head of Development Management/ Senior Planning Officer.
