The site is in countryside not zoned for development, but policy allows exceptions for equestrian buildings where justified; the officer accepted the principle due to the applicants' high-level breedi…
General Policy 3
Prohibits development outside zoned areas except for specific countryside exceptions including 'building and engineering operations which are essential for the conduct of agriculture or forestry'. Officer applied equestrian as a policy-permitted exception justified by functional need for horse breeding/training on open rural land, despite not explicitly listed.
Environment Policy 19
Permits equestrian development in countryside only if no loss of local amenity, no loss of high quality agricultural land (Classes 1-2), and highways can accommodate traffic. Assessed as compliant with no amenity/highway objections raised and no mention of land class issues.
Environment Policy 21
Prohibits animal stabling buildings detrimental to countryside character in siting/design/size/finish; requires form/materials reflecting purpose (no cavity-wall). Tested against large size/width but found acceptable as agricultural barn-like with green sheeting, mitigations, and similar to approved Island schemes; no significant visual harm after screening.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Equestrian use only
The building may be used only for equestrian purposes (and for the keeping of ewes/lambs during spring time lambing). REASON: the countryside is protected from development and an exception is being made on the basis of equestrian need. As such the building must be used for the purposes for which it is approved.
No external lights
No approval is hereby given for any external lights to be installed to the approved building unless otherwise agreed in writing with the planning authority. Reason: In the interests of the character and appearance of the site and surrounding area.
Removal if use ceases
The equestrian building hereby approved shall be removed and the ground restored to its former condition in the event that it is no longer used or required for equestrian purposes. Reason: The building has been exceptionally approved solely to meet equestrian need and its subsequent retention would result in an unwarranted intrusion in the countryside.
Dark green materials
The external roof and walls on the new building must be a dark green/olive green colour and be retained thereafter. Reason: In the interests of the character and appearance of the site and surrounding area.
Remove existing temporaries
Within one month of the building hereby approved being occupied, the existing temporary field shelter and the horse box trailer (green in colour) are to remove from site. Reason: In the interests of the character and appearance of the site and surrounding area.
Training tied to Praslin
The equestrian building may only be used for the training of horses owned by, or under the training, or guidance of the yard manager/owner in association with the occupation of the principal dwelling 'Praslin'. Reason: To safeguard the residential character and amenities of the area.
Landscaping scheme
Notwithstanding the landscaping details provided, no development shall take place until full details of soft landscaping works have been submitted to and approved in writing by the Planning Authority and these works shall be carried out as approved. Details of the soft landscaping works include planting along the entire western elevation of the building within the adjacent field (Nr 421019) and the height of the grass bank on the east side (which should be at least 1.5m) with planting on top of that bank of native species (gorse and hawthorn or any other appropriate species). All planting, seeding or turfing comprised in the approved details of landscaping and the erection of the bank fronting the entire eastern elevation of the building must all be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the building, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species. REASON: the landscaping of the site is an integral part of the scheme and must be implemented as approved.
Parking provision
The existing parking area shall not be used for any purpose other than the parking and turning of vehicles associated with the development and shall remain free of obstruction for such use at all times. Reason: To ensure that sufficient provision is made for off-street parking and turning of vehicles in the interests of highway safety.
