In pursuance of powers granted under the above Act and Order the Department of Infrastructure has under application reference 14/00093/D, given EXPRESS CONSENT to H. Richmond Ltd, for the erection of illuminated signage at Land On Roadside And Within Rileys Garden Centre, Robinsons And Eden Business Park, Cooil Road Braddan Isle Of Man subject to compliance with the following condition(s):
- The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
- There shall be no external lighting of the development hereby approved other than in accordance with the lighting shown on the approved drawings.
Reason: In the interests of the character and appearance of the site and surrounding area.
- Details of the proposed lighting units, the strength of lighting proposed for them and hooding proposed shall be submitted to and approved in writing by the Planning Authority prior to any lighting being installed on the site. Such lighting shall be installed and retained in accordance with those approved details.
Reason: In the interests of the character and appearance of the site and surrounding area.
- Notwithstanding the photomontage imagery submitted as part of the application, no approval is given or inferred for the text contained therein or the uses implied.
Reason: For the avoidance of doubt.
- The signage hereby granted consent shall, where illuminated, not be illuminated by an intermittent source.
Reason: In the interests of the character and appearance of the site and surrounding area.
- The signage shall not be illuminated except between 6.30am and 10.30pm.
Reason: In the interests of the character and appearance of the site and surrounding area.
- All other signage within the application site that fronts Cooil Road shall be removed within one week of the signage hereby granted consent being erected.
Reason: In the interests of the character and appearance of the site and surrounding area.

Guidance Note
This decision was made by the Planning Committee in accordance with the authority delegated to it. This permission refers only to that required under the Control of Advertisements Regulations 2005. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
Please note that in accordance with the Town and Country Planning (Appeal Fees) Order 2013, Article 4(b), any appeal lodged must be supported by the appropriate fee in order to validate the appeal.

Please note that a copy of the Officer’s report which led to the decision, together with correspondence relative to the application, are available for inspection at the Department.
The proposed development must not be commenced until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;
Whichever is the later.
If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department’s public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.
Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.
