PLANNING OFFICER REPORT AND RECOMMENDATIONS Application No. : Applicant: Proposai: Site Address: 14/00127/D Mr Edward Joyce Erection of illuminated signage 1 Bathurst Street Douglas Isle Of Man IM2 3HH Miss S E Corlett Case Officer: Photo Taken : Site Visit: Expected Decision Levei: Officer Delegation Officer's Report THE SITE 1.1 The site is the curtilage of an existing building which sits on the corner of Bathurst Street and a side lane which leads round to the rear of the properties on this side of the road. The property is a newsagent's with manager's accommodation in the floor above. The property has been vacant for some time and planning permission has recently been granted for use of the ground floor as a hot food diner and take away (PA 13/91329). 1.2 The terrace of properties on this side of Bathurst Street accommodates a range of services ■ Chinese take-away, fireplace sales, a launderette and a bakery and a vacant unit, formerly accommodating an Indian hot food take away. Opposite are the sides and rears of the residential properties on Farrant Street and Murray's Road. 1.3 The property has signage upon the front and side: the frontage signage has a long signboard across the frontage above the door and window level stating "Newsagents" and indicating what is sold. On the side of the building, alongside the lane, is a smaller sign with two newspaper logos and "Newsagents" in the middle, THE PROPOSAL 2.1 Proposed is the installation of signage. This will take the form of a frontage sign in the same place as the existing, but internally illuminated and bearing the words "The Happy Eater". A similar sign is to be erected on the side of the building where the current newpaper logos are. Each sign is to be 5200mm long and 400mm high and 150mm deep, made of pvc with yellow text set on a blue background. 2.2 Signage elsewhere on the terrace is mostly unlit: the former Indian take away had externally illuminated signage and the Chinese take away a projecting box sign which can be lit and is illuminated in the evenings. PLANNING STATUS AND POLICY 3.1 Although the terrace has commercial use exclusively at ground floor level, the site lies within an area designated on the Douglas Local Plan of 1998 as Predominantly Residential. 3.2 General Policy 6 states, "Within our towns and villages, the display of external advertisements will be permitted on the site or building to which they relate provided they: a) are of a high standard of design and material and relate well to the building and site on which they are to be displayed; b) are in keeping with and do not detract from the surrounding area; and 14 March 2014 14/00127/D Page 1 of 3

c) are located so as to not cause a highway safety hazard". 3.3 General Policy 7 states: "Within our towns and villages, the display of external advertisements on sites or buildings other than those to which they relate will not generally be permitted". PLANNING HISTORY 4.1 Planning approval has been granted for a range of developments on this site including signage, extensions and new shopfront. Planning permission was granted in 1997 (PA 97/00219) for the conversion of a shop to a hot food take away (the microfiche for this application is missing: the application was in detail and it is assumed that the details included the installation of the flue which is in situ at the rear of the property). Planning approval was granted for the conversion of the hairdresser's at number 4 to a hot food takeaway under PA 08/00775. One of the conditions of this approval was that details of the extraction system must be approved before any use commenced. The flue has been installed without the details being provided, despite the planning authority seeking clarification of this twice in 2012. It was resolved by the Department not to take any further enforcement action on the basis that the flue would have to have been approved under Environmental Health legislation. At the time of this consideration the shop unit was unused (and remains so). REPRESENTATIONS 5.1 The highway authority and Douglas Corporation do not raise any objection to the application. ASSESSMENT 6.1 The approved operating hours for this outlet are 0700hrs to 2300hrs seven days per week. The illumination should reflect this. Whilst the signage is not particularly attractive or subtle, it is little different from that elsewhere in the terrace and the illumination is unlikely to have any adverse impact on neighbouring residential property. 6.2 As such the application is recommended for approval. PARTY STATUS 7.1 The local authority, Douglas Corporation is, by virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, paragraph 6 (4) (e), considered "interested persons" and as such should be afforded party status. 7.2 The Highway Authority is granted interested party status under the Town and Country Planning (Development Procedure) (No 2) Order 2013 paragraph 6 (4) d.
