In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Andrew Saunders, Ref 25/90278/C, for the Temporary use of site for Manx produce food and drink market from May 21st to June 8th 2025 (12pm till 10pm daily) at Bottleneck Car Park Douglas Promenade Douglas Isle Of Man .
Any conditions or notes which apply to the approval are set out below. This approval is subject to compliance with any conditions listed and may not be implemented until it becomes final (see guidance notes).
Reason: The application has been approved as an exception to the Development Plan on the basis of need for the TT event only and for a one year period as proposed by the application. 2. No customers shall be served or remain in the site outside the following hours;
Monday to Sunday 1200noon to 2200hrs Reason: In the interests of the residential amenity of the area and as the times indicated where those stated within the application submission and have been considered on this basis only.
This approval relates to the submitted documents and drawing all received on 18.03.2025. This decision has been made for the following reasons(s) Overall, it is considered the proposal would be an acceptable temporary use for this year's TT race period and would have no significant adverse impact upon public or private amenity and complies with General Policy 2, Environment Policy 22 & 35, Transport Policy 7 of the IOM Strategic Plan 2016 and the Area Plan for the East 2020.

This decision was made by the Head of Development Management in accordance with the authority delegated to them.
This decision refers only to that applied for under the Town and Country Planning Act 1999 and its subordinate legislation.

A determination to grant planning approval does not have effect -
Development must be carried out in accordance with the approved plans and any attached conditions (irrespective of any changes that may separately be requested at the Building Control stage or by any other Statutory Authority). This approval does not remove the need to also comply with any other relevant legislation. Any conditions requiring certain works, submissions etc. prior to commencement of development must be fulfilled prior to work starting on site. Failure to adhere to this approval and meet the requirements of all conditions may invalidate this approval or result in formal enforcement action.
Any appeal can only be made by a person who has been accorded rights to do so, must be in writing, include the appropriate fee and be submitted to the Department within 21 days of the date of this Notice.
