Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Overall, the proposal would not unacceptably harm the characteristic of the site nor the character of its surroundings. The proposed development is also not considered to result in a significant adverse impact upon the adjoining highway, and there would be no adverse impact on neighbouring amenity. The proposal, therefore, complies with General Policy 2, Environment Policy 22 and Strategic Policy 4 of the IOM Strategic Plan 2016.

It is recommended that the following organisations should NOT be given the Right to Appeal:
1.0 SITE - 1.1 The site represents the existing curtilage of South Ramsey Bowling Green, Queens Grove, Ramsey, which is a parcel of land located on a corner plot with Queens Grove to the west and Walpole Drive to the south. The site is currently used as a bowling green which includes a number of single storey buildings associated with the bowling green use. A car park can also be found to the eastern side of the site. This car park is accessed via an existing entrance onto Walpole Drive. - 1.2 The roadside boundaries along Queens Grove and Walpole Drive are characterised by mature continuous hedgerows which have a height of approximate 2 metres.
2.0 PROPOSAL - 2.1 Planning approval is sought for Erection of replacement floodlights. The new floodlight which will be Tamlight (CRUSADER T4) 300W/4800 lm Lighting systems will be 10m tall. These lighting systems placed on poles will be positioned on the four corners of the Bowling Green pavilion, which are positioned slightly different form the position of the previous light positions. - 2.2 The applicants have stated that the new floodlight poles would be 2m taller than the existing poles, but will be repositioned so as to concentrate light coverage on the green turf, with less light spilling onto the adjacent road and surrounding properties. - 2.3 The hedge on the boundary with Queens Grove will remain untouched by the proposed alterations. There would be no changes to the parking provisions for the site.
3.1 Site Specific:
"In addition to the above, changes in the activities associated with the current permitted use of land or a building, which in themselves do not constitute development and therefore do not require planning permission, can have an adverse impact on adjacent properties by virtue of noise, light or general disturbance. For example the addition of security lighting on a property may cause light pollution affecting adjacent properties and the wider area. The introduction of new activities into established parks and recreation areas can have an impact on neighbours. In such cases the Department would advocate the person or organisation considering the change to give careful consideration to the potential impact of such activity in terms of location, siting and design."
4.1 The site has been the subject of five (5) previous planning applications one of which is considered to be materially relevant in the assessment and determination of the current application. - 4.2 Approval was granted under PA 87/04422/B for Erection of floodlights, South Ramsey Bowling Club, Walpole Road, Ramsey. This application was approved by the Planning Committee on 26.02.1988.
5.0 REPRESENTATIONS Copies of representations received can be viewed on the Government's website. This report contains summaries only.
5.1 DOI Highways find the proposal to have no significant negative impact upon highway safety, network functionality and/or parking (19 November 2024). - 5.2 Ramsey Town Commissioners have no objection to this proposal (22 November 2024). - 5.3 No comments have been received from neighbours.
6.1 The key issues to be considered with the current application are:
6.4 Impacts on Neighbours 6.4.1 With regard to potential impacts of the works on neighbouring properties, it is considered that although the new poles will sit about 2m taller than the existing light poles, the new lights would be installed within the court of the bowling green, and away from any of the neighbouring properties such that any impacts would be diminished over the existing situation. In fact, the new poles would be moved considerably into the site and away from the boundary of any of the neighbouring properties, such that light diffusion towards the neighbours would be limited. Additionally, the new lights would look inwards towards the Bowling Green and not towards the boundary, thus ensuring that there would be no adverse impacts on neighbouring amenity.
8.0 CONCLUSION - 8.1 For the reasons set out above, the works are not considered to result in adverse impact on the application property, street scene, adjoining highway and surrounding mature landscaping. The application is, therefore, considered to accord with General Policy 2, Strategic Policy 4 (b & c), and Environment Policy 22 of the Strategic Plan, and is supported.
9.0 RIGHT TO APPEAL AND RIGHT TO GIVE EVIDENCE - 9.1 The Town and Country Planning (Development Procedure) Order 2019 sets out the process for determining planning applications (including appeals). It sets out a Right to Appeal (i.e. to submit an appeal against a planning decision) and a Right to Give Evidence at Appeals (i.e. to participate in an appeal if one is submitted). - 9.2 Article A10 sets out that the right to appeal is available to:
9.3 Article 8(2)(a) requires that in determining an application, the Department must decide who has a right to appeal, in accordance with the criteria set out in article A10. - 9.4 The Order automatically affords the Right to Give Evidence to the following (no determination is required):
