TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure) Order 2019
In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by 9-TEN Media Group, Ref 25/90721/B, for the Change of use and conversion of vacant retail unit from Class 1.1 (Shop) to Class 1.3 (Food and Drink) together with external alterations to the building at 7 - 17 Wellington Street Douglas Isle Of Man IM1 2AS .
Any conditions or notes which apply to the approval are set out below. This approval is subject to compliance with any conditions listed and may not be implemented until it becomes final (see guidance notes).
Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Reason: To ensure the use of materials appropriate to the development in order to safeguard the visual amenities of the area, in accordance with policy GP2 in the Isle of Man Strategic Plan (2016).
General opening Times: Monday - Thursday 09:00 to 00:00 midnight Friday and Saturday 09:00 to 02:00 Sunday 09:00 to 23:00 Food Service Times: Monday - Sunday 09:00 to 22:00 Reason: In order to maintain the amenities of the area.
unit shall not be used other than as a public house and for no other purpose within Use Class 1.3 (food and drink); of Part 1 of the Order at any time.
Reason: The Department has assessed the impact of the proposal on the basis of the specific use and any alternative uses within the same Use Class will require further consideration.

This decision has been made for the following reasons(s) It is considered that the proposed change of use is compatible with the immediate setting of the application site and will bring a redundant unit back into active use, to the benefit of the local economy and vitality of the area. The proposed use will not give rise to unacceptable impacts upon residential amenity, the character or appearance of the Conservation Area, flood risk or other matters of acknowledged planning importance. The proposals comply with Mixed Use Proposal 2 of the Area Plan for the East and General Policy 2, Environment Policies 13, 22 and 36.

This decision was made by a Principal Planner in accordance with the authority delegated to them.
This decision refers only to that applied for under the Town and Country Planning Act 1999 and its subordinate legislation.

Implementation A determination to grant planning approval does not have effect —
Development must be carried out in accordance with the approved plans and any attached conditions (irrespective of any changes that may separately be requested at the Building Control stage or by any other Statutory Authority). This approval does not remove the need to also comply with any other relevant legislation.
Any conditions requiring certain works, submissions etc. prior to commencement of development must be fulfilled prior to work starting on site. Failure to adhere to this approval and meet the requirements of all conditions may invalidate this approval or result in formal enforcement action.
Appeal Any appeal can only be made by a person who has been accorded rights to do so, must be in writing, include the appropriate fee and be submitted to the Department within 21 days of the date of this Notice.
