General Policy 3
Requires development outside zoned areas only exceptionally for essential agriculture/forestry operations. Officer found agricultural need for machinery storage/livestock housing sufficient to justify exception, supported by equipment list and site activities, despite not being a full-time farm.
Environment Policy 1
Protects countryside unless overriding national need with no alternative. New barn's visual impact mitigated by screening and distance, not adversely affecting countryside character.
Environment Policy 3
Prohibits unacceptable loss/damage to woodland. No impact on woodland areas as site partially in woodland but field not designated; tree removal already licensed.
Environment Policy 4
Protects species/habitats of importance. Arboricultural Officer confirmed no detrimental tree impact; protection plan conditioned.
Environment Policy 15
Permits agricultural buildings if need outweighs countryside policy, sited near building groups, appropriate scale/design. Need accepted, scale similar to existing, sited 17m north but screened; materials (juniper green panels) sympathetic to landscape.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Agricultural use only
The building must be used only for agricultural purposes in association with Farrants Fort only. REASON: the countryside is protected from development and an exception is being made on the basis of agricultural need. As such the building must be used for the purposes for which it is approved.
Removal if agricultural need ceases
The agricultural barn hereby approved shall be removed and the ground restored to its former condition in the event that it is no longer used or required for agricultural/horticultural purposes for a period exceeding 24months. Reason: The building has been exceptionally approved solely to meet agricultural need and its subsequent retention would result in an unwarranted intrusion in the countryside.
Demolition of existing barn
Within 3 months of the new barn hereby approved being brought into use the existing barn as shown on drawing 24/14/02 shall be demolished and the land restored to is former condition (i.e. turfed). Reason: The countryside is protected from development and to prevent a proliferation of development and a reason to allow the new barn was due to its replacement of the existing.
No residential curtilage extension
For the avoidance of doubt no planning approval is hereby given for the extension of the residential curtilage into Field Nr 124768. Reason: No permission is sought for any extension to the residential curtilage of Farrant's Fort and as such has not been considered as part of the planning application.
Tree and hedge retention
The existing trees and hedges shall be retained in accordance with the approved details. Any retained tree or hedge which within five years of the approved development being occupied or completed (whichever is the later) dies, is removed or becomes seriously damaged or diseased shall be replaced by a similar species, of a size to be first approved in writing by the Department, during the next planting season or in accordance with a programme of replacement to be agreed in writing with the Department. Reason: To safeguard the appearance of the development and the surrounding area.
Tree protection plan
Prior to any works commencing a scheme for the protection of the retained trees (a tree protection plan) which shall be prepared in accordance with the recommendations of British Standard BS5837:2012 shall be submitted and approved in writing by the Department and shall be fully adhere to. Reason: In the interest of the protection of existing trees proposed to be retained and in the interests of the character and appearance of the countryside.
