Officer’s Report
1.0 THE SITE 1.1 The site is the curtilage of the Tesco (Formerly Shoprite) supermarket situated on the northern side of Derby Road in Peel, within a car park which mostly serves the shop. The building is a modern one, single storey but with roof lights illuminating the shop floor within. The building has a slate-like roof and mainly rendered walling with a plinth and some vertical elements of the walling finished in red/brown brick.
1.2 The site for the proposals lies forward of the main entrance at the front of the car park back of Derby Road and between existing parking spaces, and forms the main footway into the entrance to the store. To the east lies an opening which facilitates pedestrian access into the store car park from Derby Road, the vehicular access is to the west of the site.
1.3 No 38 Derby Road and Rose cottage are situated to the opposing side of Derby Road.
2.0 THE PROPOSAL 2.1 The application seeks planning approval for the Installation of an ATM machine in its own purpose built building. The ATM building would be 2.24m wide and 1.9m long with a height of 2.57 metres to the top. The building would be facing towards the store with the ATM in the elevation away from Derby Road. A overhang canopy projects forward to shelter the ATM in rain conditions. The building is proposed with White rear (to Derby Road) and white sides, with the front facing the store in blue. The ATM is located adjacent disabled parking bays for ease of access.
3.0 PLANNING POLICY 3.1 The site lies within an area designated on the Peel Local Plan as Retail. The proposal is consistent with this and as such, the following parts of the Strategic Plan are relevant:
3.2 General Policy 2 states that "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (g) does not affect adversely the amenity of local residents or the character of the locality; k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan." 3.3 Transport Policy 1: New development should, where possible, be located close to existing public transport facilities and routes, including pedestrian, cycle and rail routes.
4.0 PLANNING HISTORY 4.1 The site has had a number of previous applications relating to the store and signage.

5.1 Representation from the Department of Infrastructure (DOI) Highways Division 06.06.24 confirms that: - " the proposal will have no significant negative impact upon highway safety, network functionality and/or parking".

5.2 Two letters of objection have been received from the tow properties immediately opposite the proposed siting of the building on Derby Road these raise:
o Cash point would be an eyesore directly in front of property
o Proposal would encourage ques of people looking at our property
o Construction and colour out of keeping
o Noise potential
6.0 ASSESSMENT 6.1 The fundamental issues to consider in the assessment of this planning application are; i. The visual impact of the proposed development (GP 2) ii. Impact on Residential Amenity (GP2) iii. The suitability of the development to the area (TP1 and British Standards BS8300) The visual impact of the proposed development
6.2 In terms of the visual impact of the proposed ATM building, the building is located within the stores car park which provides ease of access to the facility it is also sited opposite the entrance to the store which facilitates a good level of natural surveillance to users. The building has been designed such that it faces in to the food store site with the ATM to the inside and as such the inside elevation is the coloured one with the elevation to Derby Road and the side elevations white in colour to give neutrality. The building is of functional appearance and has been designed to offer a service.
6.3 Whilst representations have raised the materials and colouring the building is of modest size and its main elevation face toward the existing store and as such its appearance is considered that it would not appear out of place or that it would adversely affect the character and appearance of the area, or represent an intrusive feature in the street scene. Impact on Residential Amenity (GP2)
6.4 Two properties lie to the opposite side of Derby Road and front face towards the location of the proposals and the store frontage. It was however evident when visiting the site that the location proposed for the ATM building is not directly in front of either of the properties and is more in between the two, and whilst there may be an angular view towards the structure, I would consider the distance across the road and its single storey scale and modest size mitigate this impact.
6.5 Additionally the building has been designed not to face Derby Road or the properties but with its active elevation towards the store frontage.
6.6 Whilst representations have raised the activity and noise associated the ATM building is with in an existing car park and close to a shop entrance where activity already occurs and cars manoeuvre, car lights, and engine noise and car doors etc. In addition Derby Road is a main road with a public footpath and members of the public could readily stand and look towards the properties opposite the store.
6.7 As such the proposals are not considered to result in any significant detriment to amenity and comply with policy GP 2. The suitability of the development to the area (TP1 and British Standards BS8300)
6.8 Within British Standards it is recommended that suitable illumination is provided for devices such as ATM machines in order to improve visibility of the devices and to improve the safety of those using the devices. British Standards BS8300 states "Card and coin operated devices, in particular ATMs, should be located in areas that are overlooked by people, and well lit at all times." What is proposed here would sit well with this requirement as it would be positioned at a location where there would be views from various vantage points along Derby Road, and from within the car park of the store, and from the residential properties in the

locality. Moreover, the location would be frequently visited by visitors to the store. This makes it a secure location for intended users. Besides, the location would facilitate access for all types of users as it would be easily accessible to users from Derby Road which would ensure it complies with Transport Policy 1.
6.9 Based on the foregoing, it is considered that any impacts resulting from the installation of the new ATM building on the appearance and character of the area and residential amenity would be minimal and that the application is acceptable in land-use terms.
7.0 CONCLUSION 7.1 Overall, it is concluded that the planning application is in accordance with aforementioned GP2 and TP1 of the Isle of Man Strategic Plan 2016 and is recommended for approval.
8.0 INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons: (a) the applicant (including an agent acting on their behalf); (b) any Government Department that has made written representations that the Department considers material; (c) the Highways Division of the Department of Infrastructure; (d) Manx National Heritage where it has made written representations that the Department considers material; (e) Manx Utilities where it has made written representations that the Department considers material; (f) the local authority in whose district the land the subject of the application is situated; and (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material.
8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed above who should be given Interested Person Status __
