Thank you for the email from Lucy Kinrade dated 15/06/20 in connection with the ongoing Minor Changes Application inviting submission of an amended application form.
After discussion with Lucy Kinrade on 17/06/20, please see enclosed 2 x complete copies of the following documents:
Please take this letter as a continuation section 5 of the Minor Changes Application Form as explanation of and reasoning for the proposed amendments to PA16/00681/B:
An extension of the front porch across the entire front elevation of the property
Applicant considers this a minor change as it provides visual break for the dressed stone in 2.
Facia across the front elevation of the property to the height underneath the proposed extended porch with dressed stone of a type and colour in-keeping with the immediate surrounding area.
Applicant considers this a minor change as it maintains the visual amenity with the two newly developed adjacent properties and with a car bay at the top of Gellings Avenue on Cronk Road, see photographs enclosed.
To include an additional unobscured window 600mm x 1200mm on the ground floor of the Cronk Road elevation in the porch area to provide natural lighting internally to the porch
Applicant considers this a minor change as the window does not overlook anything other than the Cronk Road retaining stone wall, and is not visible from properties on Cronk Road, being entirely below Cronk Road level.
Applicant considers this a minor change as the window will be obscured, and hence cannot overlook any aspect of Cronk Road.
Applicant considers these minor changes as after completion of the building in accordance with the planning application, planning permission would not be required for a loft conversion as there are no external alterations to the roof/building, other than as mentioned in 6) & 7).
Applicant considers these minor changes as after completion of the building in accordance with the planning application, these changes would fall under permitted development under Class 28 of the Town and Country (Permitted Development Order) 2012.
Applicant considers this a minor change as the window only directly overlooks adjacent properties roof lines and does not overlook any properties front or rear elevations on Victoria Road and Gellings Avenue as it is perpendicular to them and at 900mm x 1100mm the window is comparatively small.
Applicant considers this a minor change as after completion of the building in accordance with the planning application, these changes would fall under permitted development under Class 25 of the Town and Country (Permitted Development Order) 2012.
Applicant considers this a minor change as colour specification considered trivial.
Applicant considers this a minor change as after completion of the building in accordance with the planning application, internal alterations would not be subject to planning consent.

In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Anorgarth Limited, Ref 16/00681/B, for the Erection of a dwelling with integral garage at Vacant Plot With Garage Gellings Avenue Port St. Mary Isle Of Man subject to compliance with the following condition(s) and notes (if any) :
Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals. 2. Prior to the occupation of the dwelling hereby approved, the boundary wall adjacent to Gellings Avenue shall be reduced to 1 m in height and retained as such thereafter. If the wall is to be capped, it shall be capped with stonework unless otherwise agreed in advance with the Department.
Reason: to ensure adequate visibility in the interest of highway safety. 3. No approval is hereby given for the demolition and re-building of the boundary wall, unless otherwise agreed in advance with the Department.
Reason: In the interest of protecting the character and appearance of the area. 4. Prior to occupation of the dwelling hereby approved, the garage and parking space shall be made available for the parking of a vehicle and shall remain free from obstruction and available for parking thereafter.
Reason: To ensure that the car parking standards are met in the interest of highway safety. The development hereby approved relates to Drawings 03 and 04, date-stamped as having been received 14th June 2016, also to Drawing 02 Revision 01, date-stamped as having been received 1st September 2016, and also to Drawing 01 Revision 03, date-stamped as having been received 21st November 2016.

This decision was made by the Planning Committee in accordance with the authority delegated to it in the name of the Minister and/or in the name and on behalf of the Department.

Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain:
