The officer considered shipping containers as structures under the Town and Country Planning Act 1999 when sited for more than a short period without mobility.
General Policy 2
General Policy 2 permits development in accordance with land-use zoning in Area Plans, provided it respects site and surroundings in siting, layout, scale, form, design; does not adversely affect landscape/townscape character, local residents' amenity, or locality character; provides satisfactory access, parking, and manoeuvring; and does not unacceptably affect road safety or traffic. The officer tested the retrospective container siting against criteria b, c, g, h, and i, finding no visual harm due to its location within an industrial site and backdrop of existing buildings, no amenity or highway impacts, thus fully compliant with the industrial zoning.
Removal if use ceases
The container shall be removed and the ground restored to its former condition in the event that it is no longer used or required for its approved use. Reason: The building has been exceptionally approved solely to meet need and its subsequent retention for any other purpose would require assessment via a separate planning application.
