The officer assessed the main issues as impact on neighbouring properties and on the character/quality of the surrounding landscape in an Area of High Landscape Value.
Environment Policy 1
Protects countryside outside settlements or non-designated areas from adverse development unless overriding national need. Officer found works do not adversely affect countryside and positively contribute via native planting/biodiversity, addressing parish objection.
Environment Policy 2
In AHLVs, protects landscape character unless no harm or essential location. Proposal complies with (a) as it would not harm character/quality, being screened, within residential cluster, and enhancing biodiversity; majority not highly visible from public views.
General Policy 3
Restricts development outside zoned areas except specific exceptions like agriculture/forestry works or countryside interpretation. Landscaping with native planting deemed acceptable as agricultural/open space enhancement without domestication.
Environment Policy 3
Prevents unacceptable loss/damage to woodlands of amenity/conservation value. Considered alongside Braddan Local Plan Policy 13.3 on tree/woodland management; no issues raised, assumed no objection from DEFA Arboricultural Officer.
General Policy 2
Referenced in conclusion as complied with; implies general development principles satisfied given specific policy tests passed.
Policy 13.3 (Braddan Parish District Local Plan)
Designates rural Braddan as High Landscape Value, requires tree/woodland maintenance including under-planting. Proposal's native understorey planting along tree belt aligns with this.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Fencing details and installation
Within six weeks of the decision becoming final, the details of the fencing to separate the landscaped field from the abutting residential property shall be submitted to and approved in writing by the Department, and within one month of the fencing details being approved by the Department, the fencing shall be fully installed in accordance with the approved details. The fence shall be permanently retained and maintained as such. Reason: To satisfactorily protect the character and appearance of the area and surrounding countryside.
Retention as open space/agricultural land
The land comprising the application site must remain as open space/agricultural land and shall not be used as part of the residential curtilage of the dwelling named Sunnybank House, West Baldwin or for any other residential purpose. Reason: For the avoidance of doubt and with a view to protecting the land from inappropriate domestication.

No CommentI've double checked the boundary on MannGIS & yes, you're correct. It is just over the border in Marown as per the map below (the shaded area is Marown). None of us, including your Department have spotted it.
