The officer assessed the principle of development against General Policy 3, finding it acceptable as an exception for agricultural buildings and countryside interpretation, given the established Manx …
General Policy 3
Prohibits development outside zoned areas except for agricultural buildings or countryside interpretation (exceptions f and h). Officer found proposal met GP3(f) as it supports established on-farm wool production/interpretation in countryside.
Environment Policy 2
Protects AHLV character unless no harm or location essential. Small scale, timber finish, and siting in farm cluster ensured no harm to landscape quality.
Environment Policy 3
Prevents unacceptable loss/damage to woodland. No tree removal, shed 6m from tree row in circulation area, no harm to southern woodland or access lane trees.
Environment Policy 15
Permits agricultural buildings if need outweighs countryside policy, sited near existing groups, appropriate scale/form. Wool business need proven; shed sited centrally amid farm buildings, sympathetic timber materials.
Environment Policy 18
Ancillary sales of on-site grown/produced items exempt from general retail policies. Wool produced/packaged on farm qualifies as ancillary.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Removal if use ceases
In the event that it is no longer used or required for agricultural purposes or for the operation of the wool business the building hereby approved shall be removed and the ground restored to its former condition within 3 months of the use ceasing. Reason: The building has been exceptionally approved solely to meet need and its subsequent retention would result in an unwarranted intrusion in the countryside.
Use restriction
The building must be used only for the storage and sale of products produced on the Ballacosnahan Farm holding or for ancillary agricultural purposes relating to the Ballacosnahan Farm holding. Reason: The countryside is protected from development and an exception is being made on the basis of need. As such the building must be used for the purposes for which it is approved.
