The key issue was whether demolition of the rear annexes was acceptable in the Conservation Area, per Environment Policy 30, 39 and PPS101 CA/6, which presume against demolishing buildings contributin…
Environment Policy 30
Presumes against demolition of Registered Buildings, considering condition, repair costs, retention efforts, and alternative proposals. Officer noted the building is not Registered and policies do not strictly apply to partial demolition of rear annexes with no public visibility.
Environmental Policy 39
Presumes in favour of retaining buildings positively contributing to Conservation Area character. Rear annexes not publicly visible, so demolition causes no harm to character.
CA/6 Demolition in Conservation Areas
General presumption against demolition in Conservation Areas unless building detracts from character; considers architectural/historic interest and wider effects. Applied similar criteria to ENV30 but in less clear-cut cases; annexes' rear position means no impact on area.
Time limit
The works hereby granted registered building consent shall be begun before the expiration of four years from the date of this consent. Reason: To comply with paragraph 2(2)(a) of schedule 3 of the Town and Country Planning Act 1999 and to avoid the accumulation of unimplemented registered building consents.
Scope of works
This consent relates to the demolition of the rear outlets as shown in the approved drawings and to no other works. Reason: The building is not Registered and as such, all that is within the control of this application is the demolition of the outlets as provided for by Section 19 (3) of the Town and Country Planning Act 1999.
