It is considered that the tree protection plan, as having been received on 17th May 2023, satisfy Condition 2 of the approval; the surface water drainage plan, as having been received on 9th March 2023, satisfy condition 3 of the approval, the soft landscape plan, as having been received on, 17th May 2023 satisfy condition 8 of the approval and cycle storage detail, as having been received on 17th May 2023, satisfy condition 9 of the approval; although these conditions will not be fully satisfied until such times as the works indicated on the plans have been carried out in full and retained as such.
Plans/Drawings/Information; This decision relates to the drawing no. 101 which has been received on 9th March and drawing no. 100 Rev A, 102 Rev A which have been received on 17th May 2023.
Officer’s Report Description
1.1 The above application was approved on 1st March, 2023 subject to a number of conditions including the following: - 2. No site clearance, preparatory works or development shall take place until a scheme for the protection of threes and hedgerow along the western site boundary with 12 Rheast Mooar Avenue, and appropriate working methods, has been submitted to and approved in writing by the Department. The scheme shall be implemented as approved before any equipment, machinery or materials are brought onto the site, and shall be maintained until all equipment, machinery and surplus materials have been removed from the site. Nothing shall be stored or placed within any fenced area, and the ground levels within those areas
shall not be altered, nor shall any excavation be made, without the prior written consent of the Department.
Reason: In the interest of visual amenity and biodiversity.
2.1 A tree protection plan, a surface water drainage plan, a soft landscaping plan and details of cycle storage has been provide.
Recommendation
3.1 DEFA Arboricultural Officer has no objection (23.05.2023) to the tree protection plan. The comment states the monitoring scheme should be carried out as planned.
3.2 DoI Highway Drainage has no objection (19.04.2023) to the surface water drainage plan. - 3.3 DEFA Ecosystem Policy Team has no objection (17.03.2023) to the soft landscaping plan besides the specie for the hedge at the rear boundary. This has been amended to a local species. - 3.4 The submitted soft landscape plan is considered to fit in with its surroundings, protect privacy and maintain local biodiversity. - 3.5 The submitted cycle storage detail is considered to be sufficient for cycle storage and is considered to not have a negative impact on the character of the area. - 3.6 It is considered that the details are acceptable and the development can commence.
3.7 The tree protection plan requires compliance and monitoring. The soft landscape, surface water drainage solution and bike storage all required to be built according to the approved plans. These conditions are fully discharged when soft landscape, surface water drainage solution and the bike storage have been completed according to the approved plans.
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
