No CommentMr & Mrs DL & J. MacLean
ObjectionWhilst we are not against the restoration of the existing building, we are both very concerned that the proposed rear extension would afford us no privacy to the rear of our property.; As in previous planning applications there is no mention of the existing boundary wall, or the subsequent planting and maintaining of trees and shrubs to screen us from the Far End House property.
MR & MRS D.L. J. Maclean
Objectionwe do object to the proposed near extension, which in our view would seriously overlook our garden and our main bedrooms, this would deprive us of our privacy.; Nowhere on the plan put before you does it indicate what is proposed for the boundary wall or the planting of the tubs (trees)
Mr K J. and Mrs H. J Godwin
ObjectionThere would be lack of privacy from Over looking Balconys.; Nothing Shown on the plans to reinstate the existing Boundary wall, which is rotting away.; The appearance of the Building will not be keeping within the Character of the Surrounding area.
The original planning application 12/00274/B for alterations and erection of extensions to the dwelling was approved by the Planning Authority under Article 6 of the Town & Country Planning (Development Procedure) Order 2005. An appeal was lodged by Mr & Mrs D L Maclean. The appointed person's report was considered by the Minister for Infrastructure, who concurred with the conclusions and recommendation that the appeal be dismissed. The Minister directed that the Planning Authority's approval be confirmed, but subject to amended conditions including obscure glazing for a balcony screen, tree protection, landscaping, boundary enclosures, and specific levels. Formal approval notice issued on 30 July 2012. No refusal reasons or detailed appeal arguments are provided in the decision letter.
Precedent Value
This appeal demonstrates that appellants challenging a Planning Authority's approval under Article 6 can have their appeal dismissed, with the original approval confirmed but potentially subject to stricter or amended conditions imposed by the Minister.
