28 June 2017 · Delegated - Senior Planning Officer (Chris Balmer)
The Courtyard Shops, 6, Arbory Street, Castletown, Isle Of Man, IM9 1lj
The proposal seeks to vary a condition on a prior approval (PA 16/00207/B) that converted the ground floor of a two-storey traditional shop unit in Castletown town centre from an estate agency to a hot food takeaway with retail use, by extending the permitted opening hours significantly into the evening.

The officer considered the proposal in the context of the site's location in Castletown's main shopping street within a mixed-use area, where activity and comings and goings are expected at most hours…
Strategic Policy 2 - Priority for new development to identified towns and villages
Identifies Castletown as a Service Centre for regeneration, housing, employment and services. The officer noted this supports mixed uses including takeaways in town centres to enhance vitality.

Requires development not to adversely affect townscape character, resident amenity, locality character, adjoining land, or safety/security. Assessed and found compliant as no harm to amenity or safety in busy street location with existing similar uses.
Environment Policy 35
Permits only development preserving or enhancing Conservation Area character. No external changes proposed; internal variation of hours deemed not to impact appearance.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Hours of operation
The facility may be open for business only between the hours of 0900 - 2330 Monday to Thursday, 0900 - 0030 Friday and Saturday and 1030 - 2230 on Sundays. Reason: to ensure that the operation of the facility does not result in anti-social behaviour inappropriate to this location.
no objection; proposals acceptable from a highways aspect given adjacent similar uses sharing delivery and refuse collection
hours of operation should be controlled in accordance with the proposed hours
Isle of Man Constabulary raised concerns about late-night takeaway operations attracting anti-social behaviour and recommended restricting trading hours to the proposed times; Highways Division had no opposition.
Key concern: takeaway premises acting as 'honey pots' increasing crime and anti-social behaviour opportunities late at night
Isle of Man Constabulary
Conditional No ObjectionResearch has shown that takeaway type premises act as 'honey pots.' They cause persons to remain in the area for an inordinate period of time increasing the opportunities for criminal or anti-social behaviour, especially during the evenings and late night.; I would therefore strongly recommend that the trading hours are controlled and that the following condition be placed upon any approval granted in respect of the said application.
Conditions requested: restriction on opening times for the takeaway activity to between Monday-Thursday 9am till 23.30hrs and Friday - Saturday 9am till 00.30hrs and Sunday 10.30am 22.30hrs
