The officer acknowledged that a fully self-contained unit would normally be treated as a separate dwelling, failing General Policy 3's presumption against development in the countryside, as well as En…
General Policy 3
Requires development only in zoned areas except for specific countryside exceptions like agricultural housing; no direct provision for ancillary residential accommodation or garages. Assessed as non-compliant for a separate dwelling but outweighed by site's specifics: existing structure, staff need tied to large rural dwelling with equestrian use, and minimal additional countryside impact.
Environment Policy 1
Presumption against development in the countryside. Proposal does not comply but harm limited as accommodation is in existing garage with no greater landscape impact, closely related to host dwelling.
Housing Policy 4
Directs new residential development to towns and villages. Non-compliant for countryside location but justified as ancillary staff use in existing building serving established rural dwelling.
Housing Policy 11
Relates to conversion of redundant rural buildings to dwellings; mentioned as relevant but not directly applicable to garage staff conversion.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Ancillary staff/domestic use only
The accommodation within the roof space of the garage must only be used for domestic purposes incidental to the main dwelling house, (Greenhill) and/or for the accommodation of domestic or equestrian staff working for the residents of the main dwelling house (Greenhill) and shall not be occupied as an independent dwelling unit. Reason: To ensure that the proposal remains available to meet the identified need, and as a separate dwelling would be contrary to policies to protect the countryside from unwarranted and unsustainable development.
Ground floor parking retention
The ground floor of the garage hereby approved shall at all times be made available for the parking of private motor vehicles for the occupants of the main dwelling house and shall be retained available for such use. Reason: To provide adequate off-street parking and as the garage was approved as an exception of planning policy for this purpose.
