The original application 11/01781/B for access road lighting was approved with conditions, appealed by objector Mr Cringle on landscape and amenity grounds; 11/01764/B for car park lighting was refused due to intrusive columns and light glow. Appellant arguments focused on safety needs, reduced lighting levels per professional assessments, and rejection of bollards; objector emphasized urbanising impact and prior inspector refusals. Inspector found reduced schemes balanced safety with minimal countryside and amenity harm, rejecting bollards as inadequate for shared access/car parks, and recommended dismissing A, allowing B with condition tweak, and allowing C. Minister accepted these recommendations for A and B.
Precedent Value
Demonstrates appeals can succeed by iteratively refining lighting to minimal safety standards with technical evidence, even in rural settings; establishes column lighting justifiable over bollards where uniform illumination essential for shared vehicular/pedestrian use.
