The officer identified two fundamental issues: visual amenity and highway safety. On visual amenity, the simple design, form and appearance of the garage is not of a size that would appear overly prom…
General Policy 3
Restricts development outside zoned areas except specific exceptions like essential agricultural housing or replacements. The garage was accepted as a reasonable curtilage feature within existing residential curtilage despite unzoned countryside location, akin to permitted development.
Environment Policy 1
Protects countryside ecology unless overriding national need. Proposal deemed not to adversely affect countryside due to scale, design and screening.
Environment Policy 2
Prioritises protection of AHLV unless no harm to character. Garage's simple design, matching materials and vegetation screening found not to harm landscape character.
Environment Policy 3
Prohibits unacceptable loss of woodland with amenity value. Loss of two poor condition trees accepted with no significant harm due to retained planting and DEFA non-objection.
Environment Policy 7
Protects watercourses with 8m buffer and mitigation. Within 9m but DEFA Fisheries no objection given nature of works and watercourse; note added for liaison.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Tree protection fencing
No site works or clearance shall be commenced until protective fences which conform with British Standard 5837:2012 (or any British Standard revoking and re-enacting British Standard 5837:2012 with or without modification) have been erected around any existing trees and other existing or proposed landscape areas that are to be retained as shown on DRAWING No 10 date stamped 10th December 2015. Unless and until the development has been completed these fences shall not be removed and the protected areas are to be kept clear of any building, plant equipment, material, debris and trenching, with the existing ground levels maintained, and there shall be no entry to those areas except for approved arboricultural or landscape works. Reason: To safeguard the areas to be landscaped and the existing trees and planting to be retained within the site.
Garage use restriction
The garage hereby approved shall at all times be made available for the parking of private motor vehicle(s) in association with Wood Lea and shall be retained available for such use and should not be used for storage or ancillary accommodation. Reason: In the interests of highway safety and to provide adequate off-street parking.
