Tel 01624 685950 Mr Steven Curphey Ballamoar Farm Ballamoar Lane Ballaugh IM7 5EE TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Mr Steven Curphey, Ref 16/00546/B, for the Variation of condition one of PA 12/00136/B to allow the use of the camp site for Easter weekend and between the last Friday in April to the second Monday in October, and variation of condition seven of PA 12/00136/B to allow the use of motorhomes and caravans for Easter weekend and from the last Friday in April until the 2nd Monday in October at Campsite Field 221335 Ballaugh Glen Road Ballamoar Farm Ballaugh Isle Of Man subject to compliance with the following condition(s) and notes (if any) : 1. No caravans or motorhomes or tents shall remain on the site between second Monday in October in any one year and last Friday in April, in the succeeding year, with the exception of Easter Weekend. Outwith this time the site must be used for agricultural purposes or open space. REASON: The site lies within an area where it is against the policy of the Department to allow permanent accommodation without a special agricultural (or other proven, local) need. 2. The caravans/motorhomes stationed on the site shall not be occupied as a person's sole or main place of residence. Reason: To ensure that the approved holiday accommodation is not used for permanent residential occupation. 3. Outside of TT and Manx Grand Prix and for one week either side of the associated practice and race periods the site will be restricted to a maximum of 35 motorhomes and/or caravans at any one time. Reason: In the interests of amenity and to minimise disturbance to neighbouring properties. 4. The hedgerows on the boundaries of the site shall be retained. Reason: In the interests of amenity and to ensure a satisfactory landscaped setting for the site and the protection of existing important landscape features.

Reason: For the avoidance of doubt and to safeguard the amenity of the occupiers of nearby premises. This approval relates to drawings Location Plan, Site Plan, BC-004 AI and Planning Application Notes all date stamped received 13 May 2016 and Additional Information and drawing BC-001 NUA both date stamped received 18 August 2016. Tel 01624 685950 Guidance Note This decision was made by the Planning Committee in accordance with the authority delegated to it in the name of the Minister and/or in the name and on behalf of the Department. This permission refers only to that required under the The Town and Country Planning (Development Procedure)(No 2) Order 2013. Any appeal against this decision must be in accordance with the criteria set down in that instrument. Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain: · Payment of a planning appeal fee as prescribed in the Town and Country Planning (Application and Appeal Fees) (No2) Order 2015 (currently £170); · The reasons for making the appeal; and · An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation. An appeal form and guidance notes are available from either Planning & Building Control, Tel 685950, or to download from the Department’s website https://www.gov.im/categories/planning-and-building-control/planning- applications/planning-appeals/how-to-appeal/ The proposed development must not be commenced until either; · The time for requesting an appeal has expired; or · Any appeal has been determined; Whichever is the later. If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department’s public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.
