General Policy 2
Requires development in accordance with Area Plan zoning, respecting site/surroundings in siting/layout/scale/design/landscaping, not adversely affecting landscape/townscape/amenity/road safety, providing safe access/parking, incorporating landscape features like trees. Officer assessed proposal complies as zoned residential, high quality design sits comfortably on site, adequate parking/access, tree loss acceptable.
Housing Policy 6
Residential development on zoned land must accord with Area Plan brief or criteria in para 6.2, encouraging good/innovative design. Officer noted absence of prescriptive brief but proposal meets criteria via high quality design in parkland setting.
Time limit
The development hereby permitted shall commence before the expiration of four years from the date of this notice.
Approved plans
This approval relates to the erection of a dwelling including garaging, ancillary accommodation and landscaping Plot 17, Ballanard Woods, Ballanard Road, Douglas as shown by P17-10-01, P17-10-02, P17-10-03, P17- 04, P17-10-05, P17-10-06, P17-10-07, P17-10-08, P17-10-09, P17-10-10, P17-10-12 and the Planning Statement all date stamped as received 15th November 2011 and Plan TS-01 received 9th February 2012.
Car parking and manoeuvring
The dwelling hereby permitted shall not be occupied until the car parking and manoeuvring areas have been provided in accordance with the approved plans, and those areas shall thereafter be kept available at all times for their respective purposes.
Vehicular access
The dwelling hereby permitted shall not be occupied until the vehicular means of access has been constructed in accordance with the approved plans and until the section of road up to the site has been constructed under planning permission 07/01917/B. Those means of access shall thereafter be kept available at all times for their respective purpose.
Landscaping and planting
All planting shall be carried out in accordance with the approved plans within the first planting and seeding seasons following that first occupation. Any tree or shrub which within a period of 5 years from the completion of development dies, is removed or becomes seriously damaged or diseased shall be replaced in the next planting season with another of similar size and species, unless the Planning Authority gives written consent to any variation.
Tree/shrub protection
No existing tree or shrub indicated on the approved plans to be retained shall not be cut down, grubbed out, topped, lopped, or uprooted without the written consent of the Planning Authority. Any such tree or shrub removed without such consent or dying, becoming seriously damaged or diseased within a period of 5 years from the completion of the development shall be replaced in the next planting season with another of similar size and species, unless the planning authority gives written consent to any variation.
