General Policy 2
GP2h and i require parking and manoeuvring to be accommodated within the site off-highway, essential in industrial estates to avoid difficulties for large vehicles. Assessed against amended plans showing 8 dedicated spaces (5m x 2.5m), unshared, with rear drop-off access; satisfied as traffic limited by 30-dog cap condition, gaining Highway support.
Transport Policy 7
Requires parking in accordance with current standards; industrial is 1 space per 50 sqm gross (or stricter for light industrial). For 238 sqm unit, ~5 spaces minimum but proposal provides 8 dedicated, exceeding standards for the low-intensity use with controlled drop-offs, no deliveries.
Business Policy 1
Encourages employment growth if according with Plan policies. Proposal contrary to industrial zoning but creates jobs (3 staff); officer weighed against land supply, finding no shortage impact due to ample undeveloped sites.
Business Policy 5
On industrial land, permission only for industrial/storage/distribution or limited retail. Dog day care is non-conforming use ('temporary accommodation and care of dogs during the day which does not comply'), but approved exceptionally due to site suitability and precedents.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Maximum dogs
There may be no more than 30 dogs within the premises at any time. Reason: to control the amount of traffic associated with the use to that which can be accommodated safely and conveniently on the site and the surrounding area.
do not object to the application
no objection subject to a condition which restricts the facility to accommodating no more than 30 dogs at any one time as this would limit the number of vehicles which the use generates to that which can be accommodated safely and conveniently on the site
Highway Services raised no objection subject to a condition limiting the number of dogs to 30 to control parking demand. Malew Parish Commissioners initially had no objection but noted reservations about health & safety and required appropriate permits, later confirming concerns satisfied after receiving certificates.
Key concern: health & safety aspect of the proposal
