Officer’s Report
THE APPLICATION SITE 1.1 The application site, as identified in red, is the Tesco supermarket store, Douglas. The store is situated alongside Lake Road and adjacent the River Douglas. The application relates to part of the car park, opposite the main entrance to the store.
PROPOSAL 2.1 Proposed is the erection of non-illuminated advertisement boards made from vinyl affixed on to the building elevations; fronting onto Lake Road (south) and towards the car park (west). There are a total of 10 advert boards to be installed at ground floor level.
PLANNING HISTORY 3.1 12/00843/D - Installation of illuminated and non illuminated signage. Approved.
PLANNING POLICY 4.1 In terms of local plan policy, the application site is within an area recognised as being within zoned as Retail Warehousing by the Douglas Local Plan 1998.
4.2 The draft Eastern Area Plan recognises the area as "Riverside Gateway".
4.3 In the assessment it is most relevant to consider The Control of Advertisements Regulations 2013 which makes clear that the only considerations which can be applied to applications made under them are in the interests of amenity and public safety. In the case of amenity, such things as the general characteristics of the area need to be taken into account along with the presence of any features of historic, architectural, cultural or similar interest and the public safety should consider the safety of any person using a road, railway, tramway, harbour or aerodrome including the obscuration of any traffic sign or similar.
4.4 In terms of strategic plan policy, the Isle of Man Strategic Plan 2016 contains three policies that are considered specifically material to the assessment of this current planning application; General Policy 2 states:
"Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (g) does not affect adversely the amenity of local residents or the character of the locality;
4.5 General Policy 6 states: "Within our towns and villages, the display of external advertisements will be permitted on the site or building to which they relate provided they:
(a) are of a high standard of design and materials and relate well to the building and site on which they are to be displayed; (b) are in keeping with and do not detract from the surrounding area; and (c) are located so as not to cause a highway safety hazard."
4.6 General Policy 7 states: "Within our towns and villages, the display of external advertisements on sites or buildings other than those to which they relate will not generally be permitted."

5.2 Highways Services have commented and do not object (received on 23/07/18)
ASSESMENT 6.1 The main issues to consider in the assessment of this planning application are the impact of the proposed signage on the character of the area, the existing building and the street scene.
6.2 It is considered that the proposed replacement signage would complement the modern appearance of the façade and would be relevant to the site and its use. The proposed signage is not considered to cause a detrimental impact on public or private amenity given the existing level of signage.
6.3 For the reasons mentioned above, the proposed signage is considered to be of a high standard of design and materials and relate well to the building and site on which they are to be displayed and are in keeping with and do not detract from the surrounding area
CONCLUSION 7.1 Overall, it is concluded that the planning application is in accordance with General Policy 2, 6 and 7 of the Isle of Man Strategic Plan 2016.
INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Control of Advertisements) Regulations 2013, the following persons are automatically interested persons:
o The applicant, or if there is one, the applicant's agent; o The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; o Persons to whom notice has been given under Regulation 10(3)(a)(i); o Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material; o The Highways Division of the Department of Infrastructure; o The Ports Division of the Department of Infrastructure; o The operator of the railway or tramway, and o The Local Authority in whose district the land the subject of the application is situated.
8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed above who should be given Interested Person Status. __
