Strategic Policy 1
Promotes optimising use of previously developed land and underused buildings. Officer found the nursery reuses an existing studio building on an established site, serving north Ramsey/Douglas commuters, meeting the policy's aims despite car dependency.
Strategic Policy 2 - Priority for new development to identified towns and villages
Directs development to towns and villages. Site is on secondary route to Ramsey (main service centre) but rural/unallocated; accepted due to existing uses and building reuse.
Strategic Policy 10
Minimises car journeys and protects highway safety. Assessed as acceptable with no highway objections and adequate visibility/parking.
Transport Policy 4
Highways must accommodate development safely. DOI confirmed no issues; visibility from prior approval sufficient.
Transport Policy 7
Parking per standards. Communal parking adequate for staff and short-term parental use.
General Policy 2
Presumption for zoned development respecting amenity, character, access, safety. No external changes; traffic/amenity impacts not significant; conditions safeguard interests.
General Policy 3
Restricts out-of-zone development unless exceptions apply (none here). Site established as exception via prior film studio approvals; nursery compatible without landscape harm.
Community Policy 2
Community facilities in accessible locations reusing buildings. Rural site but reuses vacant space serving local north area; car access main issue but balanced by reuse.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Maximum children
The maximum number of children attending the building at any one time shall not exceed thirty two. Reason: In the interests of the amenity of the surrounding area along with highway safety and parking and to safeguard the welfare of children.
Operating hours
No nursery customers (children or parents) shall remain in the building outside the following hours 0745hrs till 1830hrs. Reason: In the interests of the residential amenity of the area and as the application has specifically listed these times (albeit a slightly earlier opening times and later closing times are suggested, taking account of people being early and late for drop-off and pick-ups) and the application has been considered on this basis.
No play area
For the avoidance of doubt no permission is hereby granted for the use of any part of the site to be used for the creation of a children's play area. Reason: In the interests of residential amenities and the visual amenities of the area.
No highway implications
Support the concept of the new business as positive for the North of the Island
Recommend approval
Lezayre Parish Commissioners approved the application unanimously but raised concerns about traffic speed and visibility on Jurby Road; Highways Division has no highways interest and does not oppose.
Key concern: visibility is particularly bad when looking in the direction of Ramsey
Lezayre Parish Commissioners
SupportApproved Unanimous; Although the Commissioners approve this application, they do have concerns regarding the speed of traffic on this part of the Jurby Road, which has a open speed limit. The visibility is particularly bad when looking in the direction of Ramsey.; A similar comment was made by planning in relation to PA11/01061/C for the same site. "The visibility available to drivers emerging from the site onto the Jurby Road is not adequate for the proposed use which is likely to result in an increase in traffic using the access."
Lezayre Parish Commissioners
No CommentThe Commissioners would like to defer their decisions on the following planning applications until after their meeting which will take place on Thursday 5th April 2018.; I will inform the planning department of my Commissioners' decisions on Friday 6th April 2018.
