The original application 11/00750/A for approval in principle for erection of a dwelling on Field 432558, Douglas Road, Ballasalla was refused by the Department of Infrastructure. The appellant argued the site is amongst dwellings, disrupted by a gas pipeline making grazing unsafe, and needed for a high net worth individual justifying countryside policy exceptions. The Council defended refusal citing restrictive countryside policies (Strategic Policy 2, General Policy 3, Housing Policy 4, Environment Policy 2), High Landscape Value designation, lack of exceptions, and prior dismissed appeals. The inspector found no sufficient justification to override policies, giving limited weight to pipeline disruption and high net worth arguments, and dismissed the appeal. The Minister accepted the recommendation on 8 December 2011.
