The Town and Country Planning (Development Procedure)(No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Mr Edwin Davies OBE, Ref 16/00998/A, for the Approval in principle for the erection of a detached dwelling with garaging at Field 432538 Ballavoddan Farm Phildraw Road Ballasalla I sle Of Man subject to compliance with the following condition(s) and notes (if any) :

1. The development hereby approved shall be begun either before the expiration of four years from the date of this approval or before the expiration of two years from the date of approval of the last of the reserved matters.

Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013.

1. Details of the siting, design, external appearance, internal layout, means of access, drainage of foul and surface water, and the landscaping of the site (hereinafter called "the reserved matters") shall be submitted to and approved in writing by the Department before any development is commenced and thereafter the development shall only be carried out in accordance with the details as approved.

Reason: To comply with the Town and Country Planning (Development Procedure)(No2) Order 2013.

1. No development shall take place until (I) a tree survey with survey plan, (II) a tree constraints plan, (III) a tree protection plan, and (IV) a tree planting plan have been provided to and approved in writing by the Department. The development shall be carried out in accordance with the tree protection plan and tree planting plan.

Reason: To ensure the provision of an appropriately treed setting to the dwelling hereby approved in line with BS5837:2012 (sections 4, 5 \& 6) and BS8545:2014.

1. All hard and/or soft landscaping works shall be carried out in accordance with the approved details. The works shall be carried out prior to the occupation of any part of the development or in accordance with the programme agreed in writing with the Department. Any trees or plants indicated on the approved scheme, which, within a period of five years from the date of planting, die, are removed or become seriously damaged or diseased shall be replaced during the next planting season with other trees or plants of a species and size to be first approved in writing by the Department. All hard landscape works shall be permanently retained in accordance with the approved details.

Reason: To ensure the provision of an appropriate landscape setting to the development.

1. The trees to the north of the application site, as shown on Drawing 2 (date-stamped as having been receive 19th August 2016), shall be retained.

Reason: To ensure the provision of an appropriate landscape setting to the development. The development hereby approved relates to Drawing 1, Drawing 2 and Drawing 16T502501, all date-stamped as having been received 19th August 2016.
