Reason: In order to safeguard the amenities of surrounding residential properties and in the interests of highway safety.
This application has been recommended for approval for the following reason. The additional use of the dwelling as a hypnotherapist practice is considered to be acceptable, without detriment to the amenities of surrounding properties or the safety and convenience of the local highway network, in compliance with General Policy 2 of the Strategic Plan (2016).

Officer’s Report
1.0 THE SITE 1.1 The application site comprises a two-storey semi-detached dwellinghouse located on the northern side of Tynwald Road, Peel. The property benefits from a generous degree of hardstanding to the front with ample space of parking in excess of 3 vehicles.
2.0 THE PROPOSAL 2.1 Planning permission is sought on a retrospective basis for the additional use of the dwelling to operate as a hypnotherapist practice.
3.0 PLANNING HISTORY 3.1 Various planning permissions exist to extend and alter the property, none of which are however considered to be of material relevance to this application. The application has detailed in their accompanying statement the following in support of the application:
No business vehicles, materials or goods are stored at the property.
4.0 PLANNING POLICY 4.1 The site lies within an area zoned as 'Predominantly Residential' in the Peel Local Plan, and is not within a Conservation Area. General Policy 2 of the Strategic Plan 2016 requires development, amongst other things, to be of a suitable design so as to respect the site and its surroundings to not adversely affecting the character of the surrounding landscape or townscape; to safeguard the amenities of surrounding residential properties and ensure adequate parking provision.
5.0 REPRESENTATIONS 5.1 Peel Town Commissioners - no response received at the time of writing.
5.2 Highway Services - Application has no significant negative impact upon highway safety, network functionality and /or parking. (17.02.22)
6.0 ASSESSMENT 6.1 The application is submitted on a retrospective basis for the additional use of the property as a hypnotherapist practice. The current operations of the practice as described in the supporting statement are noted as being at a low-level and such that the change of use has not and would continue to not result in a material impact upon the character of the locality, the amenities of surrounding residential properties or a detrimental impact upon highway safety. Likewise, ample parking is available on-site to accommodate the current level of operations in tandem with the continued use of the property as a residential dwelling.
6.2 Further to the above, due to the nature of the activities taking place within an existing residential property, it is not considered that there would be realistic scope for the activities to

intensify to such a level which could give rise to adverse impacts upon residential amenity or highway safety. Moreover, it should be stressed planning permission is sought for the additional use of the property as a hypnotherapist practice only and not any other business activity. Any additional use of the site for any other business activity would require a further planning permission and would therefore be assessed on their own merits. In this instance therefore, it is not considered that the attachment of restrictive conditions would be necessary or appropriate.
7.0 CONCLUSION 7.1 The additional use of the dwelling as a hypnotherapist practice is considered to be acceptable, without detriment to the amenities of surrounding properties or the safety and convenience of the local highway network, in compliance with General Policy 2 of the Strategic Plan (2016).
8.0 INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons: (a) the applicant (including an agent acting on their behalf); (b) any Government Department that has made written representations that the Department considers material; (c) the Highways Division of the Department of Infrastructure; (d) Manx National Heritage where it has made written representations that the Department considers material; (e) Manx Utilities where it has made written representations that the Department considers material; (f) the local authority in whose district the land the subject of the application is situated; and (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material.
8.2
The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed in Article 6(4) who should be given Interested Person Status. __
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
