Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.

Officer’s Report
THE SITE 1.1 The site, the Cross House, is located within the Churchyard of Maughold Church. . Historically the site of an early Christian monastery (founded 500-600AD) and contains a number of important ancient monuments. The stone wall that now surrounds the modern churchyard marks the area of the monastery enclosure. There are four ancient keeills in the churchyard, two of which can clearly be seen (to the North and East of the churchyard). Maughold Cross House within the churchyard contains a large collection of early Christian and Viking carved stone crosses. Designed by Armitage Rigby and opened by the Governor, Lord Raglan, in October 1906 to provide a place whereby the various crosses or cross-fragments.
1.2 The Site is not located within a flood risk area. The site is not allocated for development and is close to the ASSI Maughold Cliffs & Brooghs. The property is located within the Maughold Conservation Area.
THE PROPOSAL 2.1 Replace existing east glazed screen with new glazed screen which incorporates ventilation to reduce damp build up inside the shelter.
PLANNING CONSIDERATIONS 3.1 TOWN AND COUNTRY PLANNING ACT 1999 S18 Designation of conservation areas (4) Where any area is for the time being a conservation area, special attention shall be paid to the desirability of preserving or enhancing its character or appearance in the exercise, with respect to any buildings or other land in the area, of any powers under this Act

5.1 Garff Commissioners raised no objection to the application and wished to record their support for the proposals (08.02.23) 5.2 Highways Services indicated there is no highway interest in the application (03.01.23)
ASSESSMENT 6.1 The issues in this case are whether the proposed alterations to the building will preserve or enhance the character or appearance of the Conservation Area and whether the proposals will impact upon the amenity of local residents or the character of the locality.

6.2 The proposals will replace existing east glazed screen with new glazed screen which incorporates ventilation to reduce damp build up inside the shelter
6.3 Although the proposals will result in a change to the appearance of the shelter, it is considered the new screen will not result in any impact to the conservation area or on the amenity of local residents.
CONCLUSION 7.1 The proposals are considered to be beneficial to the building helping to preserve it and its significant content and will have no impact upon the character or appearance of the conservation area does not affect adversely the amenity of local residents or the character of the locality or and to be in accordance with the Strategic Plan policies, Policies of Planning Policy Statement 1/01 and is supported.
INTERESTED PERSON STATUS
8.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons: (a) the applicant (including an agent acting on their behalf); (b) any Government Department that has made written representations that the Department considers material; (c) the Highways Division of the Department of Infrastructure; (d) Manx National Heritage where it has made written representations that the Department considers material; (e) Manx Utilities where it has made written representations that the Department considers material; (f) the local authority in whose district the land the subject of the application is situated; and (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material.
8.2 In addition to those above, the Regulation 9(3) requires the Department to decide which persons (if any) who have made representations with respect to the application, should be treated as having sufficient interest in the subject matter of the application to take part in any subsequent proceedings relating to the application. __
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
