The officer considered the sole issue to be whether extending leisure hours from 1700-2300hrs to 1700-0130hrs on Fridays and Saturdays was acceptable.
Strategic Policy 1
Requires optimising previously developed land, efficient site use, and utilising existing infrastructure. The officer cited this as a base for assessment, noting the proposal re-uses an industrial unit in a mixed-use area with good access to transport.
Strategic Policy 10
Promotes integrated transport to minimise car journeys, use public transport, protect highway safety, and encourage walking. Assessed positively due to site proximity to train station, taxis, and public parking, reducing car dependency.
General Policy 2
Permits development in line with zoning if it respects surroundings, protects amenity, provides access/parking, and avoids highway impacts. Proposal complies as it does not adversely affect amenity, character, or traffic in industrial setting.
Environment Policy 10
Requires flood risk assessment where risk exists. Site partly at coastal flood risk (1 in 200 year), but no assessment needed as proposal is operational variation, not new development.
Environment Policy 13
Prohibits development causing unacceptable flood risk. No issues raised for this variation.
Business Policy 1
Encourages employment growth if policies complied with. Supports leisure use extension.
Business Policy 5 - Land zoned for industrial use
Restricts non-industrial uses on industrial land. Leisure permitted in mixed-use Quayside zoning.
Transport Policy 7
Requires parking per standards (1 space/15m2 for leisure). Proposal does not fully accord due to no on-site parking, but mitigated by public options and low late-night demand.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Operating hours
The leisure facility hereby approved may be open for business only between the hours of 1700 and 0130hrs on Friday and Saturday only. Reason: To ensure that the hours of operation result in there being sufficient car parking available to serve the development and protection of possible future residential properties.
