Officer’s Report
1.0 Description 1.1 The proposed application 25/90688/C for Extension of residential curtilage (retrospective) was approved by the Planning Committee on 10.11.2025, subject to 4 conditions, one of which required submission of additional information prior to the commencement of works.
1.2 This report is specific to Condition (3) which the applicants are seeking to satisfy.
The specific wording of the condition is as follows:
Prior to the land being included within the residential curtilage, the entire boundary between the extended curtilage and the adjoining field, including the rear and side boundaries, shall be formed by one of the following: (a) a planted hedge of native species, (b) a Manx hedge constructed in accordance with Planning Circular 1/92, or (c) post-and-wire fencing supplemented by established vegetation.
Photographic evidence confirming the boundary's establishment shall be submitted to the Department within 1 month of this work being carried out.
Any plants that die, are removed, or become seriously damaged or diseased within 5 years of planting shall be replaced in the next planting season with others of similar size and

25/10151/AIR species. The residential curtilage shall be laid out in accordance with the submitted plan and retained as such thereafter.
Reason: To reflect the historic curtilage associated with the dwelling and ensure the entire boundary is clearly defined in the interest of protecting the countryside, in accordance with EP1, SP4, and GP2.
2.0 Proposal 2.1 The applicant has submitted details relating to the curtilage definition, including a duly completed AIRC form on 5.12.2025. The submitted photographs clearly outline the separation between the boundary of the residential curtilage as approved, and the adjoining field, which has been indicated in blue.
3.0 Consultation 3.1 No statutory consultees were required for this submission. The supporting information provided by the applicant has been reviewed by the case officer.
4.0 Recommendation 4.1 The submitted AIRC form and accompanying photographic evidence provide sufficient detail to demonstrate that the boundary treatment has been implemented in accordance with option (c) of Condition (3) attached to planning approval 25/90688/C. The photographs clearly show the defined separation between the extended residential curtilage and the adjoining field, consistent with the approved plan. While the post-and-wire fencing is in place, the condition also requires this to be supplemented by established vegetation and maintained for five years, including replacement of any failed planting. On this basis, the submission is deemed sufficient and considered satisfactory for Condition (3), with the understanding that the supplementary vegetation required by part (c) shall be implemented and maintained in full in accordance with the approved scheme. __
I can confirm that this decision has been made by the Head of Development Management in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status
