THE SITE 1.1 The site is the residential curtilage of an existing detached dwelling situated on the western side of Glen Chass which links Howe Road with Fistard Road in the south of the Island. The property is single storey with additional space in the roof.

1.2 Recently an existing chimney stack on the rear was removed and replaced with a new stack.
THE PROPOSAL 2.1 Approval is sought for the retrospective replacement of the rear chimney stack.
PLANNING HISTORY 3.1 There has been no previous planning applications for the site.
PLANNING POLICY 4.1 The site lies within an area designated not designated for development on the Area Plan for the South 2013. There is a general presumption against development as set out in General Policy 3 and Environment Policy 1 of the Strategic Plan although Housing Policies 15 and 16 make reference to existing rural dwellings and how development to these should be considered, they split the two into traditional and non-traditional dwellings and most relevant in this case would be Housing Policy 16. In addition the Residential Design Guide 2021 is a material consideration.

5.2 Department of Infrastructure Highway Services - No highways interest (13/10/2022)
ASSESSMENT 6.1 The new stack replaces the existing one in the same position and of a similar design. The stack is situated as the rear with limited public views. The proposal is not to have any adverse visual harm to the existing dwelling nor to the amenity of the neighbours or from public view.
CONCLUSION 7.1 The proposal is considered to be acceptable and to comply with HP16 and the general principles of the RDG 2021.
INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons: (a) the applicant (including an agent acting on their behalf); (b) any Government Department that has made written representations that the Department considers material; (c) the Highways Division of the Department of Infrastructure; (d) Manx National Heritage where it has made written representations that the Department considers material; (e) Manx Utilities where it has made written representations that the Department considers material; (f) the local authority in whose district the land the subject of the application is situated; and (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material.
