Tel 01624 685950 TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure) Order 2019 In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Mr John Kinrade, Ref 25/90838/C, for the Use of Site as a Storage Compound for Construction Equipment and Site Office (Retrospective). at Ballalough Richmond Hill Douglas Isle Of Man IM4 1JH . Any conditions or notes which apply to the approval are set out below. This approval is subject to compliance with any conditions listed and may not be implemented until it becomes final (see guidance notes). 1. The development hereby approved is limited to: i. the use of the existing fenced compound for the storage of construction and scaffolding equipment; and ii. the use of the existing portacabins located immediately outside the fenced compound as a site office in association with the use as a storage compound. Reason: For the avoidance of doubt, to define the extent and nature of what has been approved, and to ensure that no alternative compound, storage activity or office arrangement is introduced without further permission, in accordance with General Policy 2 and Strategic Policy 1. 2. No new external lighting shall be installed along the north-western boundary of the site other than lighting designed, positioned and operated in accordance with the recommendations of the Bat Conservation Trust and Institution of Lighting Professionals Guidance Note 8: Bats and Artificial Lighting (2018). Any lighting installed in this location shall be directed downwards and away from the Middle River Wildlife Site, shall use warm white light not exceeding 2700K, and shall operate only when necessary, through the use of timers, sensors or equivalent automatic controls. Reason: To safeguard species and habitats within the adjacent Middle River Wildlife Site and to prevent light spill in accordance with General Policy 2(d), and Environment Policies 4 and 5. Tel 01624 685950 o DWG 25_819_03 Rev A - Existing & Proposed Site & Floor Plan - received 16 December 2025 o Drawing Issue Sheet - received 17 December 2025 This decision has been made for the following reasons(s) The proposal is acceptable as the site is designated as Industrial Land in the Area Plan for the East (2020), and while the use does not fall within the specific industrial categories supported under Employment Proposal 1, it is functionally compatible with the established character and employment role of the Ballalough industrial estate and remains wholly within the designated industrial area, in accordance with Employment Proposal 7. The continued use of the existing enclosed compound introduces no new built development, results in no expansion of the industrial footprint, and maintains established access, parking and drainage arrangements. The development gives rise to no unacceptable visual, amenity, ecological, highway or flood risk impacts and accords with the relevant provisions of the Strategic Plan (2016), including Strategic Policy 1, Strategic Policy 5, General Policy 2, Business Policy 1 and Environment Policies 4, 5, 7 and 13. When read as a whole, the proposal represents an appropriate, compatible and policy compliant employment related use of allocated industrial land. Tel 01624 685950 Guidance Note This decision was made by the Planning Committee in accordance with the authority delegated to it. This decision refers only to that applied for under the Town and Country Planning Act 1999 and its subordinate legislation. A copy of the Officer’s report and any correspondence which informed the assessment and decision is available to view on the Government’s website (via https://pbc.gov.im/online- applications/) Implementation A determination to grant planning approval does not have effect - · if an appeal is submitted until the appeal is determined or withdrawn; or · if no appeal is submitted, but there are potential appellants in addition to the applicant, until the time within which an appeal may be submitted has expired (21 days from the date of this notice). Development must be carried out in accordance with the approved plans and any attached conditions (irrespective of any changes that may separately be requested at the Building Control stage or by any other Statutory Authority). This approval does not remove the need to also comply with any other relevant legislation. Any conditions requiring certain works, submissions etc. prior to commencement of development must be fulfilled prior to work starting on site. Failure to adhere to this approval and meet the requirements of all conditions may invalidate this approval or result in formal enforcement action. Appeal Any appeal can only be made by a person who has been accorded rights to do so, must be in writing, include the appropriate fee and be submitted to the Department within 21 days of the date of this Notice.
