Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
The proposals meet the tests of Section 18 of the Town and Country Planning Act 1999, as well as General Policy 2 and Environment Policy 35 of the Isle of Man Strategic Plan 2016 as they will protect and preserve the character of the Conservation Area, and the character of the surrounding townscape is not being adversely affected. The application is therefore judged to be acceptable.

1.0 THE SITE - 1.1 The site is 24 Stanley Road, Peel, within the town's Conservation Area. The property is a two bay, two storey mid-terrace dwelling with a pitched roof and painted smooth render wall finish. The properties along the north side of Stanley Road each have a step at eaves level as the road level descends to the promenade, and a characteristic rhythm of window and door openings. - 1.2 The existing front doors along the terrace are recessed relatively deep within the opening reveal, and are generally not very visible in angled views along the road. However, the existing doors are a variety of styles and ages, generally with solid lower portions and glazing of one form or another in the upper portion. A glazed fanlight is generally in place above each door. The existing door that is the subject of this application is painted timber with four panels, the upper two being glazed.
2.0 THE PROPOSAL - 2.1 The proposal is to replace the existing timber four panelled partly glazed door with a composite UPVC door with two semi-circular glazed panels in its upper portion. The solid elements of the door are proposed to have the appearance of painted vertical timber panelling.
3.0 PLANNING POLICY - 3.1 The site lies within an area designated on the Peel Local Plan of 1989 as Mixed Use and within the town's Conservation Area. The property is not in an area at risk of flooding, although Stanley Road itself has a high likelihood of surface water flooding. - 3.2 TOWN AND COUNTRY PLANNING ACT 1999

(4) Where any area is for the time being a conservation area, special attention shall be paid to the desirability of preserving or enhancing its character or appearance in the exercise, with respect to any buildings or other land in the area, of any powers under this Act.
3.3 National policy: THE ISLE OF MAN STRATEGIC PLAN 2016
General Policy 2 of the Strategic Plan: Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
Strategic Policy 4: Proposals for development must: (a) Protect or enhance the fabric and setting of Ancient Monuments, Registered Buildings(1), Conservation Areas(2), buildings and structures within National Heritage Areas and sites of archaeological interest;
will ensure that the special features contributing to the character and quality are protected against inappropriate development.
3.4 Planning Policy Statements: 1/01 Policy and Guidance Notes for the Conservation of the Historic Environment of the Isle of Man
POLICY CA/2 SPECIAL PLANNING CONSIDERATIONS When considering proposals for the possible development of any land or buildings which fall within the conservation area, the impact of such proposals upon the special character of the area, will be a material consideration when assessing the application. Where a development is proposed for land which, although not within the boundaries of the conservation area, would affect its context or setting, or views into or out of the area; such issues should be given special consideration where the character or appearance of a conservation area may be affected.
4.0 PLANNING HISTORY - 4.1 Application 07/00409/B permitted the installation of replacement windows and doors, application 15/01166/B permitted the installation of a replacement roof and roof light, as well as the installation of an additional roof light, and application 19/00776/B permitted the removal of a chimney stack.
5.0 REPRESENTATIONS Copies of representations received can be viewed on the Department's website. This report contains summaries only. - 5.1 The Department of Infrastructure Highways Division judge the application to have no significant negative impact upon highway safety, network functionality and/or parking. (27.7.2022).
6.0 ASSESSMENT - 6.1 The pertinent issue with the application is whether the proposed replacement door preserves or enhances the character or appearance of the Conservation Area in which the property sits taking into account the special character of the area. - 6.2 The front doors of the properties along the north side of Stanley Road are relatively deeply recessed within the wall opening, and as such are not visible in wider views of the terrace. The impact of the numerous existing front door styles is therefore considered to have a relatively minor impact on the road's character. With that in mind, however, although the existing doors are of varying styles, all have solid lower portions and glazed elements in their upper section and a fanlight above. Whilst the proposed door is not judged to be in a style that is traditional to the area, the timber panel effect is considered appropriate and the presence of glazing in the upper portion is consistent with the other doors along the terrace. With that in mind, on balance it is judged that the proposed door will have a neutral impact on the character of the terrace and the special character of the conservation area is considered to be preserved.
7.0 CONCLUSION - 7.1 It is judged that the proposals meet the tests of Section 18 of the Town and Country Planning Act 1999, as well as General Policy 2 and Environment Policy 35 of the Isle of Man Strategic Plan 2016 as they will protect and preserve the character and appearance of the Conservation Area, and the character of the surrounding townscape is not being adversely affected. Whilst the proposed materials are not traditional as preferred by Environment Policy 34, they are considered acceptable in this instance given that the overall impact will be to
preserve the character of the Conservation Area. It is therefore recommended that the application be approved.
