The officer found insufficient agricultural justification to outweigh the presumption against countryside development under GP3(f) and EP15, as the 25-acre holding with 50 ewes lacks evidence of need …
General Policy 3
Permits agricultural buildings essential for agriculture (f) outside zoned areas. Officer assessed no sufficient agricultural need to qualify for exemption, as storage/tools not core agriculture and small-scale operation lacks justification proportionate to size.
Environment Policy 1
Protects countryside unless overriding national need outweighs harm with no alternative. No overriding need demonstrated; shelter harms open countryside despite low flood risk.
Environment Policy 2
Protects AHLV character unless no harm or essential location. Mobile siting in exposed/sloping fields visible from road/rail harms landscape quality; no evidence of no harm.
Environment Policy 15
Requires agricultural need outweighing countryside presumption, sited near buildings, sympathetic scale/form. No need found; mobile nature prevents fixed assessment, isolated in open fields, not near groups.
Environment Policy 21
Prohibits animal shelters detrimental to countryside character/siting/design/size. Timber shelter noticeable in fields, mobile positions increase visibility/detriment.
Do not oppose; no significant negative impact upon highway safety, network functionality and/or parking
Neighbouring property owners at Thalloo Mitchell object to the retrospective application for a mobile field stable/shelter citing lack of agricultural need and visual impact in an Area of High Landscape Value; Highway Services Division has no highways objection.
Key concern: development not essential for agricultural activity in High Landscape Value area
Highway Services Division
No ObjectionAfter reviewing this Application, Highway Services HDC finds it to have no significant negative impact upon highway safety, network functionality and /or parking.

Objectionthe development is in direct contravention of the following relevant policies of the Isle of Man's Strategic Plan:- 1. General Policy 3; Environmental Policies 1 & 2 - on the basis that the development site is within the open countryside in an area of "High Landscape or Costal Value and Scenic Significance" ("AHLV"); with still no commencement of active farming activity by Mr Lace, can agricultural need for the development be justified
Conditions requested: building be utilised only for Mr Lace's agricultural, not equestrian, purposes; in the event that it is no longer required or used for Mr Lace's agricultural purposes it be removed from the land
