Officer’s Report
THE SITE 1.1 The application relates to The Shore Hotel, Laxey an existing public house sitting alongside Laxey River and Bridge and a short distance from the beach and harbour.
1.2 The existing building has two areas of signage, one across the front elevation and one on the side gable facing the river.
1.3 The current application relates to that specific signage on the side gable only. This signage is painted large lettering spelling 'SHORE HOTEL' and beneath it smaller lettering 'BREW PUB'.
THE PROPOSAL 2.1 Proposed is the installation of replacement signage on the side gable and the installation of strip light illumination above.
2.2 The proposed signage is to duplicate the size and height of the existing 'SHORE HOTEL' but is now to be fitted as stand off individual aluminium letters. Above each word is to be a single strip light pointing down to the letters.
2.3 The existing 'BREW PUB' lettering is to be removed.
PLANNING HISTORY 3.1 The site has been subject to a number or previous applications with the most recent being for a large extension and refurbishment works to the rear of the building approved under 21/00336/B and changes to windows and doors approved under 22/00468/B.
PLANNING POLICY 4.1 The site lies within an area zoned as 'Mixed Use' on the Area Plan for the East and within the Laxey Conservation Area. General Policies 6 and 7 requires signage in town or village areas to be of suitable design and that it must relate to the building on which it is to attach. Furthermore The Control of Advertisements Regulations 2013 make clear that the only considerations which can be applied to applications made under them are in the interests of protecting amenity and public safety.

5.1 Garff Commissioners - no objections (10/05/2022).
5.2 Department of Infrastructure (DOI) Highway Services -Do not oppose (05/05/2022).
ASSESSMENT 6.1 The sign would relate to the building on which it is to attach and just as the existing painted letters, the new signage is considered to be of acceptable size and scale so as to be readable by passing public without causing distraction or any new highway safety issues.
6.2 As part of the extension and refurbishment works approved under PA 21/00336/B Inland Fisheries raised concern for the potential of additional lighting at the site having disturbance issues on the river and fish particularly if this lighting was directed towards the watercourse. Even though the application did not contain any illumination a condition was added stating that 'there shall be no external lighting installed'.

6.3 The current application now proposes two down pointing LED strip lights to illuminate the signage. This illumination is to be directed to the signage and gable of the building and not directly to the watercourse. It must also be reminded that the site is located in the centre of Laxey and where there is already street lighting and activity typical for its location and where this signage and illumination would not look out of place. The building is also undergoing considerable refurbishment as so it would not be unreasonable to see such illuminated signage.
CONCLUSION 7.1 There is no objection to this application on the above basis and overall it is considered the design and siting of the sign is acceptable and it would not cause any unacceptable disturbance or harm to the watercourse. The proposal is considered to comply with General Policies 6 and 7 and would meets the general standards set out in The Control of Advertisements Regulations 2013.
INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Control of Advertisements) Regulations 2013, the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Persons to whom notice has been given under regulation 10(3)(a)(i) (d) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material; (e) The Highways Division of the Department of Infrastructure; (f) The Ports Division of the Department of Infrastructure; (g) The operator of the railway or tramway; and (h) The local authority in whose district the land the subject of the application is situated.
8.2 The Planning Committee must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed in Article 6(4) who should be given Interested Person Status. __
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
