IN THE MATTER of the Claimant’s claim dated 16 May 2025 (the “Claim”) seeking an order from this Court:

(a) quashing the decision of the Minister for the Department of Environment, Food and Agriculture dated 17 February 2025 allowing the planning appeal (Appeal Ref: AP 24/0043) of Richard Copisarow against refusal of his planning application 23/00958/B and approval of the same (the “Decision”); and,

(b) remitting the Decision to the Department for redetermination.

HAVING read the Claim and the noting in relation to the disposal of this matter that the Defendant has filed and served an Acknowledgement of Service indicating an intention not to contest the Claim along with an indication that the Defendant is content with the wording of the draft Order filed and served by the Claimant with the Claim Form IT IS HEREBY ORDERED that:-

1. The Decision is hereby quashed and the Decision is remitted to the Department for redetermination.

2. The Claimant pays the Defendant’s costs to be assessed on the standard basis in default of agreement.
