Spatial Policy 5
Spatial Policy 5 relates to building in defined settlements, but site is countryside 'white land'; GP3 provides exceptions for countryside development which this proposal does not fit directly, so assessed as ancillary within residential curtilage instead.
General Policy 2
Requires general development control principles including design, scale, siting, and materials (a-n); officer found proposal complies as design reflects existing proportions, materials soften appearance, and it avoids detrimental impact.
General Policy 3
Applies to land not designated for development; proposal for upward extension does not fit specific criteria (a-h) but accepted due to location within established residential curtilage and minimal impact.
Environment Policy 1
Protects countryside for its own sake and restricts adverse visual impact; extension has minimal visual impact, subordinate to main dwelling, and softens appearance in coastal landscape (E10 Castletown Bay).
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Ancillary use restriction
The first floor accommodation over existing detached swimming pool hereby approved shall only be used in association with the main dwelling house "Sea Mount" and for purposes incidental to the use of main dwelling house "Sea Mount" as a single dwelling, for no commercial purposes and only in accordance with the internal layout shown on plan 21 1597 03 received on the 04.04.2022. Reason: The dwelling is within a single residential plot within an area not designated for development. The application does not propose to create separate units of accommodation within the site and has not been considered as such.
