Dear Sir/Madam,
ON APPEAL: 97/772 - Selective Properties Limited - Approval in principle for residential development, Land between Groudle Road, Groudle Glen, Whitebridge Road and Windermere Drive, Onchan
I refer to the recent appeal hearing in respect of the above planning application.
In accordance with the provisions of paragraph 7(5) of Schedule 1 to the Isle of Man Planning Scheme (Development Plan) Order 1982, I am enclosing herewith a copy of the report of the person appointed to hear this appeal.
The Minister has considered the report, and concurs with the appointed person's conclusions and, in particular, with those in paragraphs 128 and 129 concerning the proposed public open space.
Accordingly, the Minister directed that there should be formulated a legal agreement under section 18 of the Town and Country Planning Act, 1991, such as to ensure the future retention of the proposed area of public open space as such.
This Agreement has now been concluded, with the general effect that the proposed open space will be safeguarded from built development and will be available to be used by the public as open space.
The Minister has therefore now accepted the recommendation that the appeal should be allowed, and has directed that the Planning Committee's decision to refuse planning permission should be reversed, and that approval should be granted subject to the conditions referred to in para. 130 of the report.
