The site represents the curtilage of Ard Jerkyll the headquarters of the Manx Society for the Prevention of Cruelty to Animals, situated between Foxdale and the Eairy, on the northern side of the A24. the site accommodates a range of buildings including animal shelters, a cafe, administration facilities and car parking.
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as white land, that is not designated for development.

Since the introduction of the cafe facilities and the expansion of the facilities and capacity of the centre, this now attracts more visitors than previously and from time to time this results in the car parking facilities proving inadequate and vehicles being parked on the road, to the detriment of road safety and the appearance of the area which is predominantly rural. Proposed is an expansion of the existing roadside car park to provide a further 24 spaces. The spaces shown are not full width spaces (2.4m by 2.8m) and in fact 20 spaces could be provided within the area shown. The area is to be surfaced in crushed concrete. The existing car park is not sealed or finished in tarmacadam.
Department of Transport Highways and Traffic Division and Malew Parish Commissioners indicate that they have no objection to the application.
The provision of sufficient parking is important to avoid road safety hazards and the visual impact of vehicles parked on the highway. The frontage around the site is already affected by the entrance to the facility, signage, lighting and the additional area to be hard surfaced will be visible only fleetingly as one passes the site and when the entrance gates are closed, the view into the site is limited. When the gates are open, they partially screen the proposed extended car park area.
The proposal is considered acceptable.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
