General Policy 3
Permits buildings essential for agriculture or forestry (including horticulture) as an exception to the general ban on countryside development. Officer found the polytunnel essential for the horticultural business's compost testing needs.
Environment Policy 1
Protects countryside unless overriding national need outweighs protection and no alternative exists. Horticultural need for business growth was deemed overriding.
Environment Policy 2
Protects AHLV character unless development does not harm landscape or location is essential. Siting ensured no harm due to screening and intermittent distant views.
Environment Policy 15
Requires agricultural/horticultural buildings close to existing groups, appropriate scale/form, sympathetic to landscape. Polytunnel sited next to existing facilities, low height, within sod bank.
Environment Policy 17
Permits nursery/market garden facilities if in keeping with surroundings, no adverse amenity/highway impact, screened from highways. Proposal screened, no impacts raised.
Business Policy 1
Encourages employment growth if according with other policies. Supports continued growth of composting business.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Removal if use ceases
If the horticultural use of the polytunnel hereby approved ceases for a period exceeding 12 months, the polytunnel and any supporting base shall be removed and the ground restored to its former condition within 3 months of the date of the cessation, unless a time is otherwise approved in writing by the Department. Reason: The building has been exceptionally approved solely to meet a specific need and its subsequent retention would result in an unwarranted intrusion in the countryside.
