DATE: March 2009 This report has been complied to assess the details submitted 16th March 2009 in accordance with Condition 6 of Planning Permission 08/01607/B, which was granted 20th January 2009. Condition 6 stated: "No development shall take place until full details of a landscaping scheme shall have been submitted to and be approved in writing by the Planning Authority and these works shall be carried out as approved. All planting shall be carried out in accordance with the approved details in the next planting and seeding seasons. Any tree or shrub which within a period of 5 years from the completion of the landscaping works, is removed, or becomes seriously damaged or diseased shall be replaced in the next planting season with another of similar size and species, unless the Planning Authority gives written consent to any variation." Condition 6 was attached to the approval with the appointed Inspector stating: "In my opinion, there would be benefit to have [sic] an additional planning condition relating to landscaping the boundary land within the ownership of DoLGE, particularly on the eastern side, in order to mitigate any damage done by tree felling on the side exposed to public view from the A3." Whilst the objectives of this condition are understood, from visiting the site and viewing it with reference to the site plan submitted as part of the application, it is judged that there is and would remain a significant amount of tree planting to provide screening to the site as viewed from the A3. Not withstanding this, the submitted details aimed at satisfying this condition identify an area which is not currently planted. It is proposed to plant a row of trees to provide additional screening to the site. The submitted plan shows a band of Mountain Ash planted at 5 metre intervals. The trees would be 3 metres in height at the time of planting and once mature would have a height of between 8 and 10 metres. This information has been submitted following consultation with the Department of Agriculture Fisheries and Forestry. It is considered that the proposed planting scheme would provide improved screening to the existing substantial planting and as such adequately satisfies the requirements of Condition 6. The development hereby permitted shall commence before the expiration of four years from the date of this notice. 2. This approval relates to the proposed extension to the existing Western Civic Amenity Site as indicated in the submitted documents and drawings 1155-01,1155-02,1155-1, 1155-P1, 101 Rev 2, 102 Rev 1, 201 Rev 3, 202 Rev Rev 2, all received on 8th August 2008. 3. The site may operate between the hours of 10.00 a.m. and 4.00 p.m. (last load accepted at 3.45 p.m.). 4. Private vehicles shall remain on site only for the duration of delivering or picking up materials. 5. The range of waste admitted onto the site shall be as for the existing facility and covered in the Waste Licence. 6. No development shall take place until full details of a landscaping scheme shall have been submitted to and be approved in writing by the Planning Authority and these works shall be carried out as approved. It should be noted that it is an offence under Manx legislation to permit the discharge of polluting or harmful matter to any public sewers or watercourses. Appropriate measures must be taken by the developer / occupier of the premises to ensure compliance with the legislation.
