Officer's Report
The Site
The site is the footprint of an existing building situated on the western side of Athol Street. The building is presently used as residential accommodation - three floors of such with windows only on the Athol Street side.
Planning Status
The site lies within an area designated as Predominantly Shopping. On the draft Southern Area Plan the site lies within an area of Mixed Use.
The Proposal
Proposed is the additional use of the property as tourist accommodation as well as residential. No changes to the building are proposed.
Planning Policy
Business Policy 13 states "Permission will generally be given for the use of private residential properties as tourist accommodation providing that it can be demonstrated that such use would not compromise the amenities of neighbouring residents".
Planning History
Planning permission was granted for the installation of a balcony under PA 92/1076 and further alterations under PA 90/0171.
Representations
Port St. Mary Commissioners and Highways and Traffic Division indicate that they do not oppose the application.
Assessment
The centre of Port St. Mary is historic and quaint and the type of location which visitors to the Island would appreciate and enjoy. The village centre has a number of commercial operations in the vicinity of the quay and harbour and as such the proposed use would not be out of keeping, nor detrimental to the amenities of adjacent occupants.
As such the proposed use is considered to be acceptable and the application is recommended for approval.
Party Status
The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
