The application site represents the curtilage of 3 Victoria Road, Castletown. The property is a midterrace dwelling located on the western side of Victoria Road.
The site is located within an area identified as Predominantly Residential by the Castletown Local Plan 1990. The site is also identified as being within the Castletown Conservation Area. Planning Policy Statement 1/01 'Conservation of the Historic Environment of the Isle of Man', Policy CA/2 states:
"When considering proposals for the possible development of any land or buildings which fall within the conservation area, the impact of such proposals upon the special character of the area, will be a material consideration when assessing the application."
There have been no previous planning applications considered relevant to the assessment and determination of this application.
Castletown Commissioners have not commented on this planning application. The Department of Transport Highways Division have indicated no objection to this planning application.
The Inland Fisheries Development Manager has issued a note relating to disturbance to the watercourse.
The Department of Transport Drainage Division have issued a note relating to the discharge of surface water.
The Manx Electricity Authority have issued a note relating to underground cables/overhead lines. We have received no privately written representations in relation to this planning application.
The application seeks approval for the construction of a conservatory to the rear elevation. The conservatory is to be (width depth maximum height) in size, white PVC and erected on the existing roof terrace adjacent to the study.
As the dwelling is within a Conservation Area extra consideration must be given. The existing roof terrace to the rear of the dwelling can be viewed from the adjacent property 5 Victoria Road. The proposed conservatory is to be set back approximately 10 cm from the existing study and due to its siting and orientation it will only be slightly visible to the residents of 5 Victoria Road.
It is judged that the proposed conservatory will not create any issues of overlooking and will not have an adverse impact on the neighbouring properties. Overall the proposed conservatory would not have would not have a detrimental impact to the dwelling, the surrounding properties or the Conservation Area.
With regard to the note issued by the Inland Fisheries Development Manager it is confirmed that the proposed conservatory will have no impact on the Silverburn River.
The notes suggested by the Department of Transport Drainage Division and the Manx Electricity Authority are not material planning considerations and for that reason are not attached to the report, as part of the recommendation
It is recommended that the application be permitted.
It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded interested party status:
