The site represents the residential curtilage of Failte, Clay Head Road, Baldrine, which is a modern single/two storey detached property, located on the western side of Clay Head Road.
Land Use Zoning
The site has been zoned under the Laxey and Lonan Local Plan as being within an area of predominately residential use, the site is not within a Conservation Area.
The following planning application is considered relevant in the assessment and determination of this application:-
Alterations and extensions to dwelling and erection of a detached garage - 04/02000/B - APPROVED
The proposal seeks approval for the retrospective application for the erection of a large single storey extension to the western elevation of the dwelling. Additionally, the proposal includes the erection of a single storey extension to the southern elevation.
Lonan Parish Commissioners have objected to the application on the following grounds:- The Board examined both the original application and the retrospective one and took the view that the owner should have realised that, given the size of alterations, a planning amendment should have been applied for in respect of them at the time of the original application or immediately subsequent to it. The Board consistently resists retrospective planning applications of this type and therefore recommends that the application should be refused.
Highway Division have no objection subject to the following the following condition:- Parking arrangements on site shall comply with the provisions of Manx Roads 1. The access drive arrangements shall comprise of a turning feature to permit a motor car to turn round within the site, so that a vehicle can emerge from the site in forward gear.
The Drainage Division makes no comment on the merit of the proposed development but request that an informative note be attached to any approval decision notice.
The Authority has received no privately written representations objecting to the application.
Whilst the proposal is a large extension, the proposal, however the site is within an area zoned as predominately residential use, and given the site can easily accommodate the proposed extensions, and therefore not an overdevelopment of the site.
Additionally, the extension would not result in any adverse impacts upon the residential amenity of the neighbouring properties, due to the siting of the extensions in relation of the surrounding neighbouring properties, the difference in ground levels and given the distance the extensions would be from these neighbouring properties.
The Commissioners have objected that the applicant should have amended the previous application or a subsequent application soon after. However, under the Town and Country Planning Act, retrospective applications require the same consideration as a normal application and cannot be refused on the grounds that they are retrospective.
For these reasons the proposals would be appropriate in these locations and therefore my recommendation is for an approval.
I consider that the following meet the criteria of Government Circular 1/06 and should be afforded interested party status:

This approval relates to the extensions as indicated in the submitted documents and drawings 00 896/1, 00 896/2 and WL/04/918/2B all received on 1st May 2008.
In the interest of road safety parking arrangements on site shall comply with the provisions of Manx Roads 1 and the access drive arrangements shall comprise of a turning feature to permit a motor car to turn round within the site, so that a vehicle can emerge from the site in forward gear.
There must be No discharge of surface water (including that from roofs and paved areas) from this proposed development to any foul drainage system(s) so as to comply with the requirements of the Department of Transport Drainage Division and the Sewerage Act 1999.
The application states that the surface water from the proposed development is to be discharged to the "existing drainage". If this "existing drainage" discharges (directly or indirectly) to the foul sewerage system then it should be noted that an alternative means of surface water disposal must be provided.
