In accordance with paragraph 8.2 of Schedule 1 of the above Order, the person appointed by the Government in Council to consider the application has submitted his report.
After consideration the Governor in Council has accepted the recommendations contained in that report and the application is approved subject to the conditions attached to the report.
In accordance with paragraphs 8.3(a) and (b), a copy of the appointed person's report is enclosed.

Crown Division Government Offices Douglas Isle of Man IM1 3PN 3 March 2006 Your Excellency Planning application 05/2110 Applicant: Department of Local Government and the Environment Application: Supplementary Planning Application to address Reserved Matters on land at the corner of Johnny Watterson's Lane and Ballanard Road, Douglas.
- I have the honour to report that on 30 January 2006 I inspected the site of the proposed development. The application is being dealt with under the written representations procedure. This report contains a site description, a summary of statements from the applicant department and comments from other departments. The report concludes with my assessment and recommendation.
Site Description
- The application site is on the north-western edge of Douglas. It is undeveloped open land bounded on the south and west by roads. To the north it adjoins open countryside.
The Application
The material points are:
- Planning permission was granted in March 2005 (PA 04/965) for a housing development of mixed types totalling some 147 houses and flats. This application relates to details required by the following conditions:
(a) Condition (3): detailed design of the junctions between the estate roads and Johnny Watterson's Lane. (b) Condition (9): detailed landscaping scheme. (c) Condition (11): details of the surface run-off disposal arrangements. (d) Condition (12): details of external finishes.
Reports
The material points are: Department of Local Government and the Environment -
- The appropriate authorities have indicated they are satisfied with the highway and drainage details subject to appropriate conditions. The submitted landscaping details, which include detailed landscaping proposals, a tree survey of existing trees and a specification for the sod banks, are satisfactory. The details of the external finishes are also satisfactory and would result in pleasing and appropriate buildings which would sit comfortably together and in the landscape.
Schedule Of Conditions
1) No work other than the installation of services shall be commenced until the estate road junction with the adopted highway, including sight lines and pedestrian crossing facilities, are set out to the satisfaction of the planning authority after consultation with the highway authority. 2) No development shall commence until details of flow calculations for both surface and foul water and longitudinal sections for all proposed drainage runs for foul and surface drainage have been approved.
