The site represents the curtilage of The Albert Hotel, an existing public house situated on the western side of Athol Street in the heart of Port St. Mary. The site accommodates the building itself and a walled car parking area to the south.
The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Predominantly Shopping. On the draft Area Plan for the village the site is within an area of Mixed Use Village which embraces a variety of uses reflecting the mixture of uses in the village centre. The site lies within a proposed Conservation Area identified on the draft Area Plan but this proposal has not been formally adopted or promoted by the Department.
The hotel has been the subject of a number of applications for alterations and extensions:

Proposed here is the erection of a first floor conservatory extension on part of the rear of the property alongside the rear of the attached property to the north west, above an existing flat roofed store, which is to be extended into the yard and with a new staircase from the new accommodation to the rear yard. The proposal will result in a larger kitchen for the hotel and replacement utility room.
The proposal is not the same as that refused under PA 99/1746 either in scale or location and the proposed conservatory and flat roofed area is lower than that proposed previously and will have an existing boundary wall between it and the Queen Street properties. As such, the proposal does not have the same impact as that proposed and refused previously.
REPRESENTATIONS Port St. Mary commissioners and Department of Transport Highways and Traffic Division raise no objection to the application. The Isle of Man Fire and Rescue Service recommends liaison in respect of the Fire Precautions Act.
The proposed development tidies up the existing rear elevation and will provide greater kitchen space within the existing building. The accommodation provided is limited and the open patio will be screened from the adjoining property by their boundary wall. The proposal will not have any impact on the neighbouring property or the public from whom the development is screened by the hotel.
The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
The Isle of Man Fire and Rescue Service raises issues which are the responsibility of other legislation and as such should not be afforded party status in this instance. As the matters raised are not material planning considerations, they should not be referred to in the planning notice.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.
This permission relates to the alterations and extensions shown in drawings 1359-01 and -02 both received on 2st April, 2008.
